Krauthammer: Decision not to indict NYPD officer 'totally incomprehensible'

Charles Krauthammer said Wednesday on "Special Report with Bret Baier" that a grand jury's decision not to indict a New York City police officer in the death of Eric Garner, an unarmed black man who died in July after the officer placed him in a chokehold, is "totally incomprehensible."

"It looks like they at least might have indicted him on something like involuntary manslaughter at the very least," Krauthammer, a syndicated columnist and Fox News contributor, said. "The guy was unarmed, and the crime was petty as they come. He was selling loose cigarettes, which in and of itself is almost absurd that somebody has to die over that."

Definition of “homicide” as per the website Findlaw.com;

The very first sentence reads;

“To begin with, not all homicides are crimes.”

Accident is what this is. Your repeating of the word “homicide” is not the end all be all in deciding wrongdoing.

The NYC Medical Examiners office released its autopsy report, its pretty clear cut. Its not an accusation, its the facts.

One does not exhale all the contents of ones lungs with every breath... You can easily have your ability to inhale restricted to a point of noticeable choking and still be able to make sounds/speech and be in distress.

Yeah, as an individual who wasn’t on the jury, you are correct. However, if the general public, from across the political spectrum, shares my opinion, then that is not without consequence.

Just because a death was ruled a homicide does not, in fact, mean it was murder, manslauther, voluntary manslaughter or involuntary manslaughter or wrongful death.

A coroner is not a criminal judge or jury or grand jury.

Is it?

No, it is not.

You don’t have any evidence at all to support your claim other than WAAAAAHHHHHHH, IT’S THIS, BECAUSE I SAY SO.

You don’t think the grand jury saw the coroner’s report?

All they needed was 12/23 to indict and they had 8 blacks.

SO OBVIOUSLY THE EVIDENCE IN THE CASE DOES NOT SUPPORT ANY OF THE AVAILABLE CHARGES.

Yeah, there’s lots of people in this country who are ruled by their irrational emotions.

That’s one of many reasons that this country is falling.

People have brains, but refuse to use them.

What I can’t understand is why they needed so many cops there, waste of resources. Just taser the guy if he resists arrest.

Reminds be of seeing the 2-3 patrol cars in the highway shooting radar at people - I’d rather have cops focused on crimes against property and people.

You start letting him sell cigarettes unregulated, what happens next? Then others do the same thing. Pretty soon it’s all over town that folks can sell cigarettes on the street with impunity.

No, you are talking as if the grand jury’s determination is equivalent to fact, when it is not. Others are free to disagree with their OPINION on the matter, whether you like it or not.

"It's a little strange to hear petty demagoguery like that from Krauthammer. Not unprecedented but strange. One could also say "He was selling loose cigarettes, which in and of itself is almost absurd to resist arrest over."

An excellent point. It's a shame this guy died, and the justification for what the cops did is nowhere near as clear cut as in the Michael Brown case. But whether it was over a petty law or not is irrelevant.

Garner was resisting arrest, and he WAS doing that BEFORE the chokehold was applied. I can understand panic behavior once his airway was cut off, so to me it's important to consider that he was resisting arrest before that happened. Did he panic immediately when surrounded by cops? That's possible, too.
