The shooting happened just after midnight, back on May 16, 2010.
A SWAT team had conducted a raid to search for a murder suspect. Weekly ended up being first through the door.
There was even a film crew on hand to film for a reality show about murder investigations. Weekley says that another SWAT member had thrown a flash-bang grenade, which temporarily blinded him. Thats when he fired the shot that killed Aiyana who was asleep on the couch in the front room of the house.
Doubling down on this claim, in court he actually testified that Aiyanas grandmother had somehow touched his gun, which made him fire the shot. But he failed to explain how he could tell she had done this when he claimed he couldnt see anything at the time.
The prosecution noted that even having his finger on the trigger of his submachine gun was improper. He could have avoided injury if he had followed his training, Assistant Wayne County Prosecutor Robert Moran explained.
He didnt, and as a result of him not following his training and not following the mandates of ordinary care, someone was killed.
But ultimately, the arguments and reason didnt win out.

Are you implying that you would knowingly hide a murderer in your upstairs flat and conspire to kill another individual by providing your own gun to the murderer upstairs and then expect the cops to knock politely on your door and ask to come in?.........LOL!
God bless you and yours.
God bless you and yours.
You took the words right out of my mouth.
God bless you and yours.
I don't do that and they don't do that and you know it.
God bless you and yours.
First off Chauncey Owens, the now convicted murderer, was found upstairs in the duplex that was raided. His accomplice in the murder was Aiyana's father, Charles Jones.........Chauncey Owens, the wanted murderer, was the boyfriend of Aiyana's aunt........If you don't want the cops to come knockin' then you don't allow murderers to live in your house or even come near you......
Here is the house, 4054 Lillibridge
"Three days later, Chauncey Owens was charged with first-degree murder in connection with the death of Je'Rean Blake. Aiyana's father Charles Jones was also held in conspiracy of the murder of Je'Rean Blake and is believed to be the person who provided the gun that killed Blake.[15]
In a last-minute plea bargain, Chauncey Owens admitted to killing 17-year-old Je'Rean Blake and agreed to testify that Charles Jones (Aiyana's father) gave him the gun he used to shoot the teen for giving him a dirty look.
In a voice so soft that Wayne County Circuit Judge Richard Skutt had him repeat his statement, Owens said he got the gun "from C.J. ... Charles Jones." Jones had been placed in the truck with Owens before, but Owens' admission was the first time anyone said on the record that he was more than a passive observer.
Michigan law says that anyone who "procures, counsels, aids or abets" in the commission of a crime may be tried and convicted as if he or she had directly committed the offense.
The plea to second-degree murder calls for Owens to serve 28 years for the killing and an additional two years for using a gun in the commission of a felony, in exchange for his testimony about who gave him the gun.[22],
Both Owens and Charles Jones had extensive criminal pasts. In 1995, Owens was charged with breaking and entering and faced charges for escaping from prison. In 2005, he was charged with unlawfully driving an automobile. Jones was charged in 2001 with two counts of unarmed robbery. In 2004, Jones was charged with fleeing and eluding police while driving a stolen vehicle. The charges were later dropped. Jones never actually spent time in jail, and instead cut a deal with prosecutors and was placed on probation.[23]
Uh-huh. So when in the pursuit of a murderer it’s acceptable for the police to accidentally kill children.
Had a civilian accidentally shot the child then there’d absolutely be charges being brought regardless of the circumstance. And it’s crap like this is part of why people are upset in Ferguson. The Ferguson thing is no longer about Michael Brown (not that it ever really was). It’s about people being tired of being policed by a nearly unaccountable über class.
I grew up with this crap in California and I don’t miss it at all. And I’m not black. But I totally understand being abused by police and then not having any way to stop the abuse because who do you call when you need protection from the people who are supposed to protect you?
SWAT teams have been used to serve warrants for past-due student loans, rental evictions, traffic tickets, and for enforcing environmental regulations against land owners.
These days 'attracting a SWAT team' usually means the gearheads with badges are looking for something to do. If you want substantiation then read Radley Balko's Rise of the Warrior Cop.
Your argument sounds more and more like the crap the Ferguson "protestors" are living on.............
Oh well, it is what it is I guess..........
Would you request a friendly chat to find out why he was so angry?
“Let’s put this whole story into the proper perspective......”
Yes, let’s put this in perspective. The only reason she is dead is because cops first used a smoke bomb, affecting their vision. Stupid is as stupid does. I personally wouldn’t blind myself while operating inside an environment where the other side has the home team advantage for knowing the layout already. Then again, it makes a handy excuse for F’en up.
Second, the officer was negligent in handling his weapons. He is claiming to be a professional and knows how to properly handle weapons, then fails to do so.
THAT IS THE ONLY REASON SHE IS DEAD. Seriously, cops are supposed to be accountable for their own actions. What a wonderful world they must live in, if they can blame anything they do on the suspect. Under that logic, why not just go in and hose the place?
I’ve never seen anyone as irresponsible as a cop. Most grade schoolers are held to higher standards for mistakes.
“As a side note, how would YOU handle the apprehension of an individual who in cold blood planned and murdered another person simply because he looked at him the wrong way?
Would you request a friendly chat to find out why he was so angry? “
This is what people like you and cloudedmind miss. THERE ARE OTHER OPTIONS. Most of these raids could be avoided with just a little work and thinking. But when the only tool in your box is a hammer, all problems look like a nail.
Do you remember the Jose case in Pima County AZ? They knew where he worked and everything. Now a person looking to avoid using paramilitary tactics might have simply taken him into custody at work, rather than risk a raid.
What make you think they couldn’t avoid it in this case. Face it, their default mode is to justify SWAT existence by using it as much as possible, and making no effort to not need it.
However I would handle it I can assure you that "Shoot the little girl" would not be on my checklist.
Well, since you put it that way, it's perfectly fine that the police shot a little girl.
Clever come back but the truth is, you DON'T know how you would handle it........
How about we start with the grandmother turning in both Chauncey Owens, the murderer and Charles Jones, Aiyana's father and the accomplice in the premeditated murder........? That would have prevented the tragedy that occurred.
Maybe she should have stopped reading the signs...........
Nope, that's not what I said at all.........
You know darn well what I'm saying and all my prior posts show that an unfortunate death could have been avoided had the residents of the house chose not to harbor a murderer but rather turn him in......and that goes for the father too.
"No Snitchin!".........
And that's all I'm gonna say about that...........
So it’s the dad’s fault and he should be charged with felony murder because a cop shot his daughter while trying to arrest a third party?
“So its the dads fault and he should be charged with felony murder because a cop shot his daughter while trying to arrest a third party?”
You’ll never get some to hold cops accountable for their own actions, even though he clearly violated weapon safety. Everyone else is responsible, except for the cop.
Under this logic, I could shoot the guy holding me up in traffic and declare it is his fault. “He cause me to do this.”
Cop attitude. “My job is to hold you accountable for every bad choice, mistake, and even accident you make. But don’t you dare think I should be accountable for anything I do.”
Cops are worse than school children when it comes to responsibility.
You’ve written some of the stupidest stuff I’ve seen on FR in a long time.
And, I don’t need your blessing.
I don't bless you; God does. God bless you and assuage that anger that seems to be eating you up.
WHY do you care ONE iota about what I write? No one MAKES you read my posts. Why read the posts of someone you don't like? That makes NO sense. Lol.
If you dislike my posts DON'T READ THEM. Geez, who's the stupid one for reading them?
There are PLENTY of posters I ignore.
