Society can and does regulate (proscribe) many things. The people say that pedophilia is wrong. The people say incest is wrong. Dry counties are approved in multiple states. Penicillin is proscribed...

Fundamentally free people can freely walk into voting booths and freely vote to regulate. They can also choose to allow, such as the people of Nevada allowing prostitution.

Like hell it was. My question stated the relationship of rights to privileges as being in that order. Your reply evaded the question and misrepresented the subject. The first question concerning regulation of anything in America is jurisdiction - whether the suggested regulation impinges on pre-existing rights. If it does, then it is an illegal regulation on its face, whether or not it is passed.

Your evasion of this clearly presented issue, both here and in my question to you, identifies you as rejecting these Constitutional protections in favor of unlimited regulatory totalitarianism. In other words, a Leftist.

Now that you are properly identified, I have nothing else to say to you. I don't waste my time with collectivists - I've found they're all quite insane, and that they get extremely angry when I propose there are places their lust for power is forever barred by God.

I've got to add, do you even know how the Constitution WORKS? Is smoking in the Constitution? No? That MEANS it's a God- given right, fool. Read up on negative rights.

But then again, you don't have to - you already understand. That's why you put "smoke" - your main issue - in parenthesis, cobbled with an insult. Because you can't say it directly and you know it, and you know why.

Is the Board of Health elected or appointed? If appointed, then fire them. If elected, then recall them.

Until 2005 Rockport Ma was the only dry town in the Commonwealth. The town itself voted to change that. As much as I personally object to prohibitions of alcohol or tobacco (I use neither) I do favor local control vs. federal or state control. If Westminster supports this, as wrong as it is, it’s better than Washington DC imposing school lunch menues.

You know what’s funny? I mentioned that story to my wife last night, without mentioning what state it was in, and I asked her to guess what state.

She guessed correctly! LOL. Its amazing its how obvious a nanny state Massachusetts is.

Its funny that my wife was able to correctly guess what state this took place in, when I asked her to after telling her the story without mentioning Massachusetts by name.

Yeah, let’s hope that they wake up soon (from the looks of the spontaneous citizen outrage at the end of this story, there is at least there is the germ of a tea party style rebellion in the rural parts of that state).
