The Six States With No Constitutional Right to Keep and Bear Arms

There are six states with constitutions that don’t explicitly protect the right of the people to keep and bear arms. The last state to add such a protection was Wisconsin, in 1998. The last stage of the process to amend the Badger State’s founding document was via a referendum and it passed with an overwhelming 74% of the vote. The sorry six that still lack enshrinement of the RKBA are listed below. And it won’t surprise you that these states are some of the least supportive of gun ownership and Second Amendment rights . . .

I guess Iowa is the only one that surprises me. Hey Iowans. You need to fix this. Don't think the others are fixable in the near future.

Take a guess and then scroll down to see if you are right. Also read the article to see how each state has rationalized their way to keep guns out of our hands.

If you want to hear how AZ keeps us armed and free, listen to the excellent Charles Heller, a local conservative talk show host on late Sunday mornings 10:AM Liberty Watch and 12pm American Armed and Free

http://kvoi.com/schedule/

He is also one of the most informed and intelligent interviewers on the radio. Upload his podcast, they are very intellectually stimulating.

http://www.libertywatchradio.com/

One of his most distressing subjects is how in AZ you don’t need no stinking open carry licence, but if you show or brandish your gun to ward away someone who is threatening you, they could call the police on you, and then the legal hell begins.

Now here are the states:

New York
New Jersey
California
Marilyn
Minnesota
Iowa

Local variant pronunciation of Maryland.

When I visited New Orleans once, I kept hearing references to a town called Nawlins.

Once I realized that it was the local pronunciation of New Orleans, all became clear.

...”but if you show or brandish your gun to ward away someone who is threatening you, they could call the police on you, and then the legal hell begins.”

This happened to a good friend of mine in FL who was being harassed by some useless P’sOS while driving home with his kids. He eventually stopped and got out of his car to confront them. They called the cops and he was arrested. The prosecuter in the county wanted to make an example of this former Eagle scout and a name for herself. With his world crumbling around him and his career on the line and likely a min 5 yeear jail sentence, he drove to the county court house one evening and 12 gauged himself. Shocked? I sure was. And deeply saddened. The folks who called him in were well known trouble makers in the area and had previous run ins with LEO’s. Think the had any remorse? Not likely.

Their failure is an assent of the US Constitution.

The original article at Gun Watch says the Sullivan Law was passed to *protect* organized crime. "Big Tim Sullivan" was and organized crime boss and one of the leaders of Tammany Hall.

If these same states enacted laws mandating the quartering of troops by citizens, would that pass Constitutional muster? Of course not.

And neither does this.

hopefully the six derelict states will reform their constitutions ASAP. We are on your side for sure...

Still and all..... the larger battle is just getting the US Constitution followed, complied with, respected.

In AZ you don’t need no stinking concealed carry licence either - as long as you stay 1000 feet away from schools (federal restriction that I have never known to be enforced) and don't carry in establishments that serve alcoholic beverages. There are other restricted locations where nobody is allowed to carry, government buildings, polling places, etc. but the restrictions for people with and without concealed carry permits are the same.

Of course the big variable in AZ is Indian reservations. Some tribes follow state law and some have their own restrictions which, at least in terms of enforcement, are not necessarily the same for tribal members and non-members.

Why does Iowa surprise you? Iowa is a blue state. The only difference between Iowa and Minnesota is Iowa does not share a border with Canada.

The federal 1000’ school boundary exclusion does not apply to citizens of the state in question if they have a CCW permit issued by that state. But, they still can’t carry ON school grounds, but they can carry within 1000’ feet of those grounds.

Yup. . .Supremacy Clause and all that. Just because a state doesn't have it in their constitution, doesn't mean the 2nd Amendment doesn't apply in that state.

Are you saying that Iowa is also overrun with Somalians and is an exporter of Jihadis?
