Allowing Lower Court Rulings on Same-Sex Marriage to Stand-Tragic, Indefensible & Judicial Activism
Senator Ted Cruz Official Website ^ | October 6, 2014 | U.S. Sen. Ted Cruz

Posted on 10/06/2014 3:23:04 PM PDT by BurningOak

WASHINGTON, DC -- U.S. Sen. Ted Cruz, R-Texas, today issued the following statement regarding the Supreme Court’s decision to reject requests from five States to review state laws that prohibit same-sex marriage.

“The Supreme Court’s decision to let rulings by lower court judges stand that redefine marriage is both tragic and indefensible,” said Sen. Cruz. “By refusing to rule if the States can define marriage, the Supreme Court is abdicating its duty to uphold the Constitution. The fact that the Supreme Court Justices, without providing any explanation whatsoever, have permitted lower courts to strike down so many state marriage laws is astonishing.

“This is judicial activism at its worst. The Constitution entrusts state legislatures, elected by the People, to define marriage consistent with the values and mores of their citizens. Unelected judges should not be imposing their policy preferences to subvert the considered judgments of democratically elected legislatures.

“The Supreme Court is, de facto, applying an extremely broad interpretation to the 14th Amendment without saying a word – an action that is likely to have far-reaching consequences. Because of the Court’s decision today, 11 States will likely now be forced to legalize same-sex marriage: Virginia, Indiana, Wisconsin, Oklahoma, Utah, North Carolina, South Carolina, West Virginia, Kansas, Colorado, and Wyoming. And this action paves the way for laws prohibiting same-sex marriage to be overturned in any state.

Time for a Constitutional Amendment on marriage. Or time to deal with the Brave New World.

(Cruz) IS DESTINED TO BE PRESIDENT; NOTHING CAN STOP IT.

A lot of things can stop it. Most of those things are Ted Cruz himself.

RR was the greatest President in the last 50 years but he was no saint, and Ted Cruz will be even better, partially because he will learn from RR errors.

HE IS DESTINED TO BE PRESIDENT...

Let me respectfully add a caveat to that.

Sen. Cruz will never be the Republican nominee. The Republican Establishment has anointed Jeb Bush, and he will be the nominee in 2016. That's already been decided. The GOP-E is preparing pseudo-conservatives to jump into the race with proper financial backing to assume the role of offensive linemen in football. Their role will be to block and tackle an unapproved candidate attempting to stop Jeb Bush from crossing the goal line; they will do this by splitting the conservative vote. They will never allow an outsider like Reagan or Cruz to seize their party again.

If Sen. Cruz is elected president, it will be because he founded a new political party which drew enough support and money to leave the Republican Party an empty husk with a lot of crony corporate backing but no voters. It will be much like what happened to the Whigs in the late 1850's.

It won't be a third party, but a viable second party replacing the Republicans.

I look at the country as slapping republicans in 2008 for the banking crisis that was in large part the result of GW Bush and his family and their attitudes towards bankers.

I look at the country as slapping republicans in 2012 for nominating someone like Romney who was completely wrong to ever consider as leading the country.

Obama is only strong when republicans are weak. And republicans are so friggin weak it makes people want to tear their hair out.

The only true fighters we have on our side are Ted Cruz, Sarah Palin, and James O’ Keefe. And Cruz is the only one with a seat in Congress. I guarantee you there is not another member of Congress who will make as strong a statement as Cruz just made.

Shiny objects issue...there is larger fish to fry then this singular issue impacting a percent or less of the population people seem to be fixated on.

There maybe a couple of others like Gohmert or Bachmann but they are generally local politicians from extremely conservative areas and no aspirations for greater positions. Cruz puts it all on the line.

If we ever see millions of people in the streets then it'll be too late for a mere Constitutional Amendment to restore decency. Better to ty for it before things go that far.

I agree. So let’s get a plan to raise USD $100 million and organize a TEA PARTY CONVENTION.

I’m serious.

A Tea Party as a new political party can win. It will carry the republican base. It will carry 2/3’s of independents. It will carry swing voters.

I believe if the money’s there for organizing, that a Tea Party could take the Presidency by a landslide.

I have never seen in my more than 50 years the American people as fed up with BOTH parties as I have seen now.

Is America a Christian land? Is NOT a shiny object issue. All moral, foreign policy, and economic affairs flow from this question.

This is it. Americans must stand up.

Coupla months ago there was a big story about how some school somewhere was being forced to stop selling its well-known, local tradition "pink cookies" in the school cafeteria, due to Michelle Obama's B.S. I posted that the people in that school district needed to stand up, sell their damn cookies and get on with life. It's THEIR school, not the Fed's.

Another FReeper send me a private message, breathlessly reminding me that it was "federal law" and "the public comment time period" was over.

So --- there's the revolutionary spirit for ya. Straight from this forum. If people don't have the fortitude to stand up for pink cookies, they damn sure aren't going to stand against pink "marriage."

What if Oklahoma said “No...you do not have the right to overturn our Constitution.”

Ha, good joke!

Here in WI, Walker and the state AG folded like cheap suits. Don't wanna make them independents and moderates mad, you know. Gotta play it safe so we can "win."

I don’t know if Sen. Cruz reads FR, but thank you Sen. Cruz for standing with and for our Judeo-Christian heritage. Thank you sir from the bottom of my heart.

If we are to do something let us stand together with Sen. Cruz and do something NOW!!!! We must all stand together.
