A Django Unchained actress is claiming she was 'handcuffed and detained' by police after being mistaken for a prostitute as she kissed her white husband.
Daniele Watts, who played slave CoCo in the award-winning film, posted the news on her Facebook page on 2 September and said her arm was cut when she was handcuffed.
Watts and her husband Brian James Lucas claim that they were kissing on a Hollywood street when police were called and they were asked to show their ID card to which Watts refused.

Exactly. We’ve got a lot of potential for good goosesteppers on this board.

The money quote.
Yet we have all these brain dead idiots pontificating about probable cause - some of whom admit to having law enforcement experience. Kissing was an indication that these were lovers, not a commercial sex encounter.

According to the movies, prostitutes don’t kiss on the mouth.
So, there goes the story...out the window.

!Because of my past experience with the law, I gave him my ID knowing we did nothing wrong and when they asked D for hers, she refused to give it because they had no right to do soAnd there it is in black and white, the reason more blacks are detained than whites

Well, there’s kissing, and there’s kissing. And were they still kissing when the police arrived, however many minutes later? And if so, would the police have challenged a white couple kissing in public for ten minutes or so? (I don’t expect a particularly fast response from police).

You might be amazed that about 99 % of even A listers in Hollywood are unrecognizable from the image you see on the screen. I live here and some of the “hottest” starlets are dog awful fugly. Cameron Diaz is a case in point - once in awhile, the national enquirer shows photos of celebrities without makeup.

In California if you are not operating a motor vehicle you are not required to produce or have ID. Cops should have done a quick field interview and left them alone. (They are also not legally required to cooperate. But two minutes of simple conversation and that’s that. )

No matter now far the culture thinks weve come I think most people still dont like to see open displays of affection by mixed race couples which could very well have been a factor as to why the police questioned them in the first place. Its not a pretty answer but it is what it is.In general, I don't like seeing open displays of affection...that's what bedrooms are for or private moments...
Concerning your point about mixed race couple being affectionate....
I don't know how old you are but in my youth I would say I would agree with you, but it is so common in today's world, I don't even notice anymore...
Police especially are trained to be colorblind so I find it hard to believe that was the motivating factor...unless the cop was a jerk which could easily be the case..

He had reason to ask for her identity and she refused, so that is why she was arrested.States can require you to STATE your name to the police (Hiibel v. Sixth Judicial District Court of Nevada) but not to produce ID. Not all states have this requirement though. California's law requiring people to produce ID on demand was struck down in Kolender v. Lawson.
Even stating your name is required ONLY if the police have a reasonable belief that the you are involved in criminal activity.
Going only by her side of the story it doesn't seem that the cops had much to go on.

"Watts and her husband Brian James Lucas claim that they were kissing on a Hollywood street when police were called and they were asked to show their ID card to which Watts refused.." Q: Are You Required To Show ID or Answer Questions To Police and Other Government Agents Upon Demand?
A: For showing an ID: The answer is NO, except ONLY under extremely limited circumstances (detention with reasonable, articulable suspicion during a Terry stop OR when being detained under probable cause for the commission of a crime.
If the police had reasonable grounds to suspect an act of prostitution, technically, under extremely limited circumstances, this could be legal.
If it's random in an area not known for prostitution, big problem for the police and the city.
If it was my daughter being treated improperly, I can't post my reaction for fear of being banned.

An American is required by law to show their identification credentials when asked by a LEO. Refusal results in arrest.Non-Americans, however, don't have to provide any credentials, FOR ANYTHING.

This is a "Hollywood Star"? She looks like the lady who cut in front of me at WalMart.
I think she looks more like a street hooker than a Walmartian.
