Six weeks after the primary runoff election, Mississippi State Sen. Chris McDaniel is launching his formal legal challenge of the election results, saying the evidence is so conclusive that he will be calling for courts to recognize him as the true victor of the race rather than calling for a new election.
Chris McDaniel clearly, clearly won the Republican vote in the runoff, McDaniel attorney Mitch Tyner said at a Monday press conference. I say that very assuredly because thats what the mathematics show. Its not what Im arguing. After the election, we did some post-election polling. We determined that of the Democrats that did cross over, 71 percent of them admitted they will not support the Republican in the general election. When you take those polling numbers and you go in and do the mathematical regressions, you can see that Chris McDaniel clearly won the runoff by 25,000 votes.
The short answer is were not asking for a new election, Tyner continued. Were simply asking that the Republican Party recognize the person who won the runoff election.
The campaign of incumbent Sen. Thad Cochran (R-MS), who was certified by the Mississippi Republican Party as having won the runoff by 7,667 votes on July 7, fired back, saying McDaniel had made repeated and baseless allegations of fraud and misconduct since the election.

Could be a better strategy, and could set McDaniel up to be the favorite in a couple of years — when Roger Wicker is up for re-election. Maybe Mitch Tyner is taking McDaniel for a ride and simply milking the process for maximum legal fees?
It’s hard for them to prove it with votes because the courts won’t let them see the books.
You can only disallow votes that are illegal. Apparently, crossovers in Mississippi are legal.

No, it's people swearing that they voted in the Republican primary but will never support a Republican candidate in the general election. By Mississippi law a voter can vote in the primary of one party only, and must intend to support the party nominations if they vote in the primary election. It looks like McDaniel is trying to get those votes thrown out.
Find 6,000 bad votes and protest. If you cant, just walk away and wait for next election.

the same cycle a misdemeanor. Tyner said the campaign had found 3,500 instances of
crossover votes, along with the 9,500 “irregular votes” and 2,275 “improperly cast”

The news media calls elections all the time based on projected numbers. Projection data per se is not unreliable and could be used to sway the court/grand jury to issue a recount.

I am just responding to the article. They are not asking for a recount. They are asking to be declared winner based on polls. Good luck with that.
