Feds raid S.C. home to seize Land Rover in EPA emission-control crackdown

When it comes to environmental regulation compliance, the Department of Homeland Security isn’t playing — as evidenced by a recent federal raid of a South Carolinian’s home to confiscate a Land Rover that violated EPA emission rules.

Jennifer Brinkley said she saw a line of law enforcement vehicles approaching her home and wondered what was wrong, the local WBTV reported. Homeland Security agents then went to her 1985 Land Rover Defender and lifted the hood.

“They popped up the hood and looked at the Vehicle Identification Number and compared it with a piece of paper and then took the car with them,” she said, WBTV reported.

She told Fox News that she was told the agents seized the vehicle because they thought it violated the Clean Air Act — though at the time, they weren’t completely sure. She also said her vehicle was just one of 40 that feds seized in various locations that same day for the same reason.

Ms. Brinkley told Fox News that she has no idea where the vehicle is now and that feds won’t tell her.

“I’m sad because I owned the car. It’s just an iconic car. I’m in disbelief … and surprised that somebody can come in and take your property,” she told Fox News. “It’s scary, it’s scary when it happens to you.

There’s a lot of misreporting on this story, as has been covered on a couple other threads.

The vehicles are believed to have been imported illegally. Makes it a customs issue. ICE, the DHS component that has jurisdiction over customs enforcement, conducted the raids.

Now, we all know that those agents could have been better used going after illegals. But these raids are within ICE’s scope, and were in the scope of their pre-DHS predecessor (old CBP).

So really just a lot of hype.

If the parents of the owners of the Land Rover had made sure that their children were taught about the federal government's constitutionally limited powers, then they'd be able to argue the following against the constitutionally indefensible seizure of the vehicle by the constitutionally tootheless EPA.

Simply put, the states have never delegated to the federal government, expressly via the Constitution, the specifc power to regulate intrastate environmental issues.

In fact, the Supreme Court has appropriately clarified that powers not expressly delegated to the feds via the Constitution are prohibited to the feds.

”From the accepted doctrine that the United States is a government of delegated powers, it follows that those not expressly granted, or reasonably to be implied from such as are conferred, are reserved to the states, or to the people. To forestall any suggestion to the contrary, the Tenth Amendment was adopted. The same proposition, otherwise stated, is that powers not granted are prohibited [emphasis added].” —United States v. Butler, 1936.

As a side note concerning the federal government's constitutionally limited powers, please consider the following. The states would sure be a dull, boring place to grow up and live in if parents were to make sure that their children were taught about the federal government's constitutionally limited powers as the Founding States had intended for those powers to be understood. /sarc

In fact, forget about traditional salesman / sucker cliches like "buying the Brooklyn Bridge." Voters now have to deal with the problem that they have foolishly traded their votes for constitutionally nonexistent rights and federal spending programs based on constitutionally nonexistant federal government powers.

The “experiment” appears to have run it’s course. As my wife said, these are only things we know about. There’s no telling how many people have been locked up.

FR folks waste a lot of time posting stupid stuff.

I wish FReepers were more interested in finding articles that boosted morale rather than the constant barrage of not just bad news but false and misrepresented bad news. What a waste of time. It doesn’t help morale IMO.

So, it was an "undocumented Land Rover"?

It's okay to bring in 50,000 illegal aliens but not one "undocumented Land Rover".
