The Kansas Supreme Court on Friday overturned death sentences for Jonathan and Reginald Carr, brothers convicted of murdering five people in one of Wichitas most notorious crime sprees.
The states high court in separate rulings issued Friday unanimously struck down three of each mans four capital murder convictions in the Dec. 15, 2000, execution-style killings of four people in a snow-covered soccer field. A remaining capital murder conviction for each man was upheld by the court, but the death sentence connected to it was vacated after a 6-1 majority said the district court judge who presided over the brothers trial the late Paul W. Clark was in error when he refused to hold separate sentencing proceedings for the men.
Justice Nancy Mortiz disagreed with the decision, saying that separate hearings would not have influenced the outcome because witness testimony, the unusually egregious facts of the case and evidence against the Carr brothers was so strong...

From Wikipedia.... “The Carr brothers, 22-year-old Reginald and 20-year-old Jonathan, already had lengthy criminal records when they began their spree.[4] On December 8, 2000, having recently arrived in Wichita, they committed armed robbery against 23-year-old assistant baseball coach, Andrew Schreiber. Three days later, they shot and mortally wounded 55-year-old cellist and librarian, Ann Walenta, as she tried to escape from them in her car; she died three days later.
Their crime spree culminated on December 14, when they invaded a home and subjected five young men and women to robbery, sexual abuse, and murder. The brothers broke into a house chosen nearly at random where Brad Heyka, Heather Muller, Aaron Sander, Jason Befort and his girlfriend, a young woman identified as ‘H.G.’, all in their twenties, were spending the night. They initially scoured the house for valuables. In a much-remarked point of tragedy, H.G. learned of Befort’s intent to propose marriage when the Carrs, by chance, discovered the engagement ring hidden in a can of popcorn. After the search, the Carrs forced their hostages to strip naked, bound and detained them, and subjected them to various forms of sexual humiliation, including rape and oral sex.[4] They also forced the men to engage in sexual acts with the women, and the women with each other. They then drove the victims to ATMs to empty their bank accounts, before finally taking them to a snowy deserted soccer complex on the outskirts of town and shooting them execution-style in the backs of their heads, leaving them for dead. The Carr brothers then drove Befort’s truck over the bodies.
They returned to the house to ransack it for more valuables, and in the process killed Nikki, H.G.’s muzzled dog. H.G. survived because her metal barrette deflected the bullet, and ran naked for more than a mile in freezing weather to report the attack and seek medical attention.
The Carr brothers, who took few precautions, were captured by the police the next day, and Reginald was identified by Schreiber and the dying Walenta. “.................This was a gruesome crime. I would take to the streets like Jesse does when he doesn’t like a verdict and demand this be over turned if this was my loved one that was killed. God please comfort the families of those slain.......the rest of my feelings I can not type.

Probably has something to do with the Carr brothers treatment of them as well as the legal system's treatment of the Carrs.
Those five young people in Wichita, Kansas chose "active compliance." . . . When it first occurred, only the Wichita Eagle paid attention to the alleged crimes of the Carr brothers. Our webzine, FrontPageMagazine.com discovered the story about a month later and published it on the Internet, whereupon it rapidly became a cause celebre but only on the Internet and in conservative papers such as The Washington Times. You will not see Tom Brokaw, Dan Rather or Peter Jennings talking about this crime. . . Focusing on "hate crimes" committed by white people might be good for a journalists career. But it gives the public a very inaccurate view of what is actually happening on the street . . . .
One place where the public could get an accurate report on inter-racial crime was the Department of Justice National Crime Victimization Survey. I have extracted and posted several times the stats for 1995 - 2008. But no longer. It appears that the Obama / Holder Dept. of Just Us and Our People refuses to publish the survey data. However the FBI still lists the race of the criminal but there is no mention of the victims' race.
BTW I recall this Wichita crime when it happened. During the trial some whites gathered outside the court house demanding justice. There was an AP report calling those people racists. I emailed the AP employee stating that I hoped that one day she would experience exactly what those victims went through.
So Kansas and Sedgwick County will go through a second round of separate trials for these now-convicted murderers to satisfy the Kansas Supreme Court that these brothers deserve the death penalty. Wunderbar!
It figures. Next thing you know they will be on the streets again. Next time you will hear about them is when they start doing what they do so well again.
