Long Beach resident Tom Greer, 80, told KNBC-TV that the burglar had said she was pregnant and asked Greer not to fire, but he shot her twice in the back anyway.
An autopsy later found that Andrea Miller, 28, was not pregnant, said coroner's spokesman Ed Winter.
Autopsy reveals Andrea Miller was not carrying a baby when she was killed Miller was allegedly working with robbery suspect Gus Adams, now arrested for 'taking part in crime that led to Andrea Miller's death' Homeowner Tom Greer claimed he discovered them attempting to rob them and shot Miller in self-defense Greer claimed Miller had begged for her life, telling him she was pregnant
Prosecutors Friday were waiting for the results of a police investigation into the killing of a burglar by an 80-year-old California homeowner who says he shot the woman in the back as she fled his home and ran down an alley, the district attorney's office said.
Long Beach police are still investigating,' said Sarah Ardalani, spokeswoman for the Los Angeles County district attorney's office. 'It's ongoing, and so we're waiting at this point.'
Prosecutors filed murder, burglary, robbery and weapons charges against Gus Adams, 26, a suspected accomplice of Miller.
He was being held on bail of more than $1 million.
A court appearance initially set for Friday was rescheduled for next month.
The murder charge is possible because Adams is accused of participating in a felony that led to a death, said Long Beach Police Chief Jim McDonnell.

She lied but she died anyway. I’ll bet she had used that “I’m pregnant” line before and with sucess
To be honest, even if she had been pregnant, she deserved to get shot. She broke into an 80 year old man’s home. That could have given the old guy a fatal heart attack, and still might before this story is done. If she was so concerned about her make believe baby, then she should not be breaking into people homes, disrupting their lives and sense of safety.
Although I agree with you, unfortunately, he is in big trouble, imho.
Maybe he wouldn't have been so pissed if they didn't break his collarbone.
She also took part in beating the crap out of the old guy, breaking his collar bone. Note to self: make sure they don’t have a gun after doing that. They might take it personally.
Maybe Joan Rivers will make a cameo appearance in court during this old man’s trial. Joan will tell the judge how ridiculous and unjust it is to charge him for anything. Joan impressed a lot of folks yesterday, coming out in strong defense of Israel protecting itself against Hama’s constant pelting of bombs.
Absolutely.
But if I were on the jury, it would be Damn the People, Damn the Law, Not Guilty!
The ‘tards (Americans Against the Tea Party) are outraged:
Yeah, some people don’t tend to like having their bones broken. I know I wouldn’t, and the likelihood of my replicating what the old guy did would be rather high.
So the liberal moral of this story is she was shot because she lied to her killer
Darn! Now he has to figure out how to get rid of that second notch on his gun........
Or maybe he could catch up to the other robber, and make the notch legitimate.
Or maybe he could catch up to the other robber, and make the notch legitimate.

Why didn’t I think of that?
“What difference does it make?”
She conducted a violent home invasion on an elderly man, and wasn’t pregnant enough (not at all as it turns out) to refrain from said activity.
He’ll plead temporary insanity in hot pursuit. He was in pain from a broken collarbone, and how was he to know if they wouldn’t circle around the block and come back later, or the next day, or the next week?
If I read & remember correctly, this was the 4th time this duo had broken into his house.
The shooting stopped time #4, so yes, it was self defense/
Oh No! He shoot a woman... As I see it, Act like a thug... Get treated like a thug....Die like a thug. My house, my stuff, my life. One thing for sure, he made sure she and her partner won’t do it again, or something worse, to someone else
California man, 80, guns down pregnant home invader:
It’s irrelevant. His life was not in danger and he executed her. He’s one cold sob, and I hope he goes to jail for this.
If that is true, then I would vote not guilty.
