Actually, the SCOTUS has *never* found that the president is superior to state governors. Therefore, Brewer could refuse to issue these licenses on the grounds that these people are not recognized as citizens of Arizona, even if they are allowed to be in the US.

As a sovereign state, Arizona does not have to issue licenses to non-citizens. That it currently does to *some* citizens should be stopped before this travesty is allowed.

Brewer should appeal. Sadly she must do so to the 9th Circuit as a whole, first, before it can be appealed to the SCOTUS.

But if the 9th Circus refuses to stay the order, AZ may be able to appeal to the Supremes. IIRC they have been issuing stays on the Obamacare abortion pills mandate

Yep, there is no congressional or AZ statute, but only an Obama executive order behind the Ninth Circus’ decision.

The Framers called it arbitrary government, poison to a republic.
