Berkeley To Force Marijuana Dispensaries To Provide Free Weed For Low-Income Patients

The city of Berkeley will require medical marijuana dispensaries to give away two percent of the amount of cannabis they sell each year free to low-income patients.

The City Council voted unanimously at Tuesday’s meeting to amend the city’s medical pot rules, which would also allow for a fourth dispensary in Berkeley.

Under the proposal, at least two percent of all medical weed dispensed at a club would have to be provided at no cost to very low-income members — and it must be the same quality that’s dispensed to regular paying customers.

This has so many problems, I don't know where to begin. The worst part is not that they are requiring marijuana to be provided for free -- but that the government is requiring businesses, any business, to give their product away for free. Not to mention that businesses have no way of verifying someone's income.

And of course that they are starting with businesses to give away drugs for free.

Today it's drugs, then grocery and clothing stores will have to give away their products for free, apartment building owners will have to let people stay there for free, car dealerships need to give away cars for free to indegents and so on...

And it better be the same quality as the ones they are selling for money... (see article excerpt above)

You got it. We are starting a trend in which there will be set asides for low income people. And the rest of us will pay for it in the form of higher prices.

I think we all know who pays for this. In the case of marijuana dispensaries, all of their paying customers will pay a little more to make up for the “free” weed given out. Hey, you figure the marijuana shop is a business, which needs to turn a profit to stay in business.

Is this not a “taking” under the meaning of of the 5th Amendment: “...nor shall private property be taken for public use, without just compensation.”?

Exactly. So, Walmart must give away products for free, and so must every other business? I think we’ve got ourselves a 4th Amendment issue here.

I suspect the pool of Berkley’s indigdants looking for free pot already exceeds to two percent of quanity of free pot that will be available. Those already in Berkley are not going to be happy when others come in clamouring for thier piece for the bud.
