Texas may sue government over illegal immigrant children

Texas attorney general Greg Abbott may sue the federal government over the influx of unaccompanied children crossing the U.S. – Mexico border. The possible lawsuit comes after the latest immigration crisis in the border state.

Abbott is considering legal action against the Obama administration after a request for $30 million in border patrol and enforcement went unanswered by Homeland Security Secretary Jeh Johnson.

“If the federal government is unwilling to secure the border, the State of Texas will be forced to resort to litigation to recoup the costs incurred to respond to this crisis,” wrote Abbott in an e-mail.

“The State of Texas is exploring any and all options, including litigation, to address the crisis our federal government has created by not living up to their Constitutional responsibility,” added Jerry Strickland, the spokesman for the attorney general. “If the federal government is unwilling to secure the border, the State of Texas will be forced to resort to litigation to recoup the costs incurred to respond to this crisis.”

What happened to the stories about Gov Perry calling out the National Guard and Texas Militias and posting them on the border to stop the kiddie invasion?

Law suits take forever - little king barry will be technically out of office by the time this reaches any conclusion - that is IF HE HAS NOT DECLARED MARTIAL LAW BY THEN.

Article IV, Section 4 of the U.S. Constitution

"The United States shall guarantee to every State in this Union a Republican Form of Government, and shall protect each of them against invasion; and on Application of the Legislature, or of the Executive (when the Legislature cannot be convened) against domestic Violence."

That basis for a suit is weak tea. I expected a more robust response from Abbott. The suit should be based on failure of the federal government to execute its responsibilities under Art. IV, Sec.4 of the Constitution:

"The United States shall guarantee to every State in this Union a Republican Form of Government, and shall protect each of them against invasion; and on Application of the Legislature, or of the Executive (when the Legislature cannot be convened) against domestic Violence."

It is the principal reason that the federal government was created and failing to carry out that responsibility ought to be considered a very grave offense.

A lawsuit is an excuse for NOT doing something.

Governors have to get some original approach. How about applying rules for health and safety of minors at summer camps? How about charging anyone who abets the invasion by transporting the children of human traficking? How about the highway patrol stopping busses and making sure all children have parental permission to be away from home?

These are just some suggestions. NOT ONE gov or DC pol has done anything to stop the invasion. Everyone in power seems to have lost the ability to respond in fast-moving crises that require action.

Isn’t that nice. Thousands are invading Texas weekly and Perry wants
to sue. Of course, it may take years to work through the judicial system.
What Perry is really saying is I don’t want to do anything about it.

Perry’s career in politics is finished.

Apparently still jaw boning it to death.

The chairman of the House Homeland Security Committee, Michael McCaul, a Texas Republican, urged President Barack Obama to immediately dispatch National Guard forces to the Southwest border "to free up Border Patrol agents so they can perform their primary mission, and that is securing the border."

Democrats have balked at earlier such Republican demands, saying merely putting more boots on the ground will be of little use. Critics say few of the migrants seek to avoid capture and instead arrive ready to surrender under the mistaken belief they will be allowed to stay.


Well of course RATS say that - the only thing acceptable to the RAT party is straight out AMNESTY for all and the chain migration commences. MILLIONS MORE WILL POUR IN AND AMERICA WILL NEVER LOOK THE SAME AGAIN.

If the US government doesn’t enforce its laws, Texas should take steps to succeed from the union.

You can bet people in Vermont, Maine, and Minnesota wouldn’t be blue states if all these illegals were dumped on them.

and do you really think a state’s national guard can stop the illegals?

Congress cannot bailout OdumBO on this, it would, just, encourage him to do it again. A court needs to tell the executive he must pay the state(s).
