Why Bergdahl Must Be Court-Martialed

The deal to free Bowe Bergdahl for five top Taliban officials would have been hard to swallow if Bergdahl had been an exemplary soldier. That the evidence suggests that Bergdahl deserted his unit makes it far more odious. Under the circumstances, Bergdahl should be court-martialed. But over at the Business Insider, Armin Rosen makes the argument that Bowe Bergdahl won’t be subject to court-martial upon his return to the U.S.

Rosen cites JAG lawyer and South Texas College of Law Professor Geoffery Corn who told Rosen that a prosecutor would have to prove beyond a reasonable doubt that Bergdahl “quit his unit with an intent to remain absent permanently — and he had to have that specific intent.”

Well, let’s see here. His fellow soldiers tell us that Bergdahl left a note indicating he no longer supported the American mission in Afghanistan, that he was leaving to start “a new life,” and left behind his weapons and body armor. How’s that for a specific intent to remain absent permanently?

If the allegations of him training the Taliban to increase the effectiveness of their IEDs WRT increasing US casualties are proven, he could face the death penalty.

I am not an expert in UCMJ, but it would seem to me that lesser charges could be found such as AWOL. Again, not an expert, but from what I read his promotion could have been withheld while AWOL. There seems to be a big gap between AWOL and Desertion. Any FREEPer in the Military like to comment?

There are many questions to be answered, and I’d rather see them addressed in a more formal manner. I don’t know how he came to be a guest of the Taliban nor do I know how he comported himself while in captivity. Those are among the questions he needs to answer. Then we can proceed as may be appropriate.

I’m with General Peters and his historical narrative of desertion over the decades on Megyn Kelly’s show the other night. Just shoot the shit! It worked well in the past and it works every time its tried to steal a line from Rush.

As his desertion — and possible treason for collaborating with the enemy — occurred in a war zone, if found guilty by court martial he should be executed.

After about 2 months ‘in country’-—He left behind:

The “note”...declaring his contempt for the USA, our military & our mission in Afghanistan.

His rifle...

His helmet....

His body armor...

His web belt equipment.....

Walked off in the middle of the night.....with adequate water & his knife.

Never listed by the Pentagon as a POW!!!

Did NOT ‘disappear’ or ‘lag behind’ in a patrol or ‘firefight’....

Survived living with the Taliban for over 5 years.

How long did Daniel Pearl live after the Taliban snatched him???????

Have we all forgotten Pearl?? —I have NOT.

Young Bergdahl is a DESERTER.

Up to 14 more American military members died looking for him to ‘rescue’ him from the Taliban.

Bergdahl the Elder appears to be a Taliban sympathizer.

A pox on both of them.
