WASHINGTON The Supreme Court on Monday turned down an appeal from James Risen, a New York Times reporter facing jail for refusing to identify a confidential source.
The courts one-line order gave no reasons but effectively sided with the government in a confrontation between what prosecutors said is an imperative to secure evidence in a national security prosecution and what journalists said is an intolerable infringement of press freedom.
The case arose from a subpoena to Mr. Risen seeking information about his source for a chapter of his 2006 book State of War. Prosecutors say they need Mr. Risens testimony to prove that the source was Jeffrey Sterling, a former Central Intelligence Agency official.

The SCOTUS knows full well what they are doing.
Certainly, SCOTUS considers the consequences of denying cert in significant cases. I wasn’t suggesting that they don’t. Generally, however, SCOTUS rejects the vast majority of petitions.
A denial of cert implies two things, IMHO: a) less than four justices voted in conference to hear the case and, b) the legal questions presented in the petition were not significant enough to garner four votes.
A passing thought:
That statement about the liberty of the press with respect to the little guy versus the big guy would lead me to think it correlates to today’s bloggers versus the mainstream media.
Which is why the State Run Media’s ass is on fire, wanting to enact a federal shield law. Then only government-approved “journalists” would be covered, and by extension, pamphleteers and bloggers would not be.
Maybe a Class Action Injunction Petition on behalf of We, the People to the entire Federal Government, including “both” parties, to Cease and Desist further implementation of the Fascist State of Obamanation?
Or we, the sheep could just continue to do nothing at all - - - .
The Bundy incident showed me what a peaceful but very insistent assembly of We The People can accomplish. Personally, I don’t know why we shouldn’t assemble in D.C. to peacefully INSIST that specific individuals in the Legislative and Executive branches vacate their elected offices immediately. It doesn’t require armed conflict or violence. They can go willing or be escorted out; it’d be their choice.
But I have almost zero tolerance for corruption and apathy and little patience for the ballot box. I like to get things done. It’s taking too long for my taste to put this country back on constitutional footing.

Ponder this:
* The GOP-E considers the Reagan Years to be the Era of THE BIG TENT.
* In the 1930’s the WW One Veterans protested the Federal Government, and camped out on the lawns near the Smithsonian.
* FDR sent in MacArthur and Eisenhower with US Cannons and Army troops to bust up the camped Vets.
* Combine the incidents above and apply to today.
* Now we have room on the green lawns of the Federal District of Corruption to stake up many tents to house many different minority political views, each tent fairly and equally protected from discrimination, of course.
Our only weapons for, We The People would abundant copies of The Bill of Rights, the US Constitution, and the Anglican Book of Prayer that was used by our Founding Fathers to write those documents.
* A suggested name for the tent city might be: “Valley Forge South.”

Defendants in a criminal trial have a right, an enforceable right, to confront witnesses. The courts have the right to compel testimony (other than self-incrimination).
