In the wake of the killings in Santa Barbara, some state lawmakers want a way people can report someone who is a threat for violence, with a process then to temporarily remove guns from that person.
One of the authors of a bill says current mental health laws and gun control laws aren't working together.
"I think we should always take a prudent review of our laws at a time like this," interim Kern County Mental Health Director Bill Walker told Eyewitness News.
But, he said with this issue, laws have to address both public safety and individual rights.
State Assemblymembers Nancy Skinner, D-Berkeley, and Das Williams, D-Santa Barbara, announced the proposal Tuesday.
"The proposed legislation would create a gun violence restraining order, establishing a system where concerned family members, intimate partners or friends can notify law enforcement of someone who is demonstrating a propensity to commit violence toward themselves or others," reads a statement on the websites for both lawmakers.
The legislators say when family members would notify law enforcement, there would be a tool to "potentially prohibit the purchase of firearms and/or remove the firearms already in possession."
The statement says authorities could investigate the threats and ask a judge to grant an order banning gun purchase or possession.
Walker said the idea should be seriously considered and debated, but he has concerns.
Bakersfield attorney Loren Kleier also has doubts.
"It's unnecessary," Kleier said. "We have plenty of statues already on the books that are in place."
He points to the "51-50" hold that trained professionals can order for someone with mental issues, and he said that has a function to remove guns.
One of his client's guns were taken after the man's girlfriend called law enforcement about his irrational behavior.

In other news, the legislature is also taking up a bill to declare “gun violence restraining orders” against all California residents who are white and own guns.
Not constitutional rights.

From what I’ve read, if one of the deputies had watched the video(s) that prompted the welfare check, the kid would have been taken to. A psych ward. No shooting.

Virtually anyone can take out an order of protection on you. They merely have to state they felt “threatened”. A pissed off neighbor or whatever. Cops come immediately and take all your guns. Guilty until proven innocent. This is the “Lautenberg Law”
What they’re proposing is not the same as your example.

We’re talking about two different groups of people. You referenced those who make the laws in Sacramento. I don’t think they care about what happens to police officers/police departments.
Oh they care about them when it comes to their own personal protection and revenue collection.

@sshole neighbor that loved loud backyard parties with no regard to hour or that we had to sleep to work the next day. He and his redneck wife decided our attempts to get them to act like normal people was harassment and got a TRO to stop calling the HOA on them. He showed up with some little weasel party buddy who swore I was a psycho and the "sorta" judge believed them that I was out to get them.
If this had been a bit less civilized place, I would have asked the bastard to take a walk with me.
Left my guns with a buddy and moved out of the wretched state of California. This new law is just making it easier for @ssholes like the redneck party animals I used to live next to.
Restraining orders have worked so well with human beings, I am sure they would work so much better with inanimate objects.

Pretty much everybody who lives around here is a Redneck and they are all good people and shooters.
You must have lived in LA, Sacto, San Fran or another city where all the assholes are concentrated.
Out here when my neighbors start shooting (pretty much every weekend) I just make sure my dogs are in the house so there wont be any accidents.
Just bear in mind most real Rednecks are good people and don’t bother their neighbors.
