Is Gay Marriage Unstoppable?

The cascade of same-sex marriage rulings is now a torrent, each more quotable and image-ready than the last. “Let us look less to the sky to see what might fall; rather, let us look to each other…and rise,” district Judge Michael McShane wrote Monday in Oregon. Not to be outdone, district Judge John E. Jones III—a George W. Bush appointee, personally recommended by Rick Santorum—wrote Tuesday in Pennsylvania: “We are a better people than what these [marriage] laws represent, and it is time to discard them into the ash heap of history."

Indeed, after Judge Jones threw out his state’s ban, same-sex marriage is now 12-0 in federal courts across the country. But the lofty rhetoric of these decisions and their legal reasoning are a far cry from Justice Anthony Kennedy’s opinion in United States v. Windsor, which invalidated the Defense of Marriage Act less than a year ago. As a challenge to a state marriage amendment or law now seems destined to end up at the Supreme Court, probably in the next term, these discrepancies should be cause for concern.

Marriages among straights will steeply decline. That’s what happened in Scandinavian countries after they legalized civil unions.

They would now be motivated to “marry” to be able to file joint IRS returns. It’s all about the money in most things, and even in this too.

We need to keep track of how many gay people are actually getting married. It seems to be increasing slightly - mostly because gays now feel compelled to do it since they carried on so much about it. But several years ago, despite the push, very few guys were getting married. Honest statistics should tell the real story.

It's actually going to be pretty funny to watch. Once alimony and "child support" kicks in along with community property those fat checkbooks are going to be a lot flatter.

In the event of a Circuit split, the Supreme Court will affirm gay marriage on a narrow Windsor argument, that the DOMAs were motivated by homophobia and hence invalid. Will probably carve away some of the more aggressive District Court reasoning if any of that survives into a Circuit decision on which it takes cert.

The only really interesting question is whether there will even be a Circuit split that compels the Supreme Court to rule. Only the Fourth, Fifth and Eleventh Circuits have even a chance of reversing a District Court opinion, and I'd go 2:1 odds that they won't be able to find their way here. I don't think that two pro-gay marriage Circuit decisions will vary enough in their reasoning for the Supreme Court to justify taking cert on the academic issue, but who knows.

SCOTUS is ‘go with the flow’ under John Roberts leadership, most definitely. Boldness is not supported unless it is from the left side. Once in a while, though, a squirrel finds an acorn.

Thanks for postin this: a truly explanatory article about why the entire judiciary is now overtly pro-gay-mirage (I say "mirage" because it's something that's delusory, but looks real): and that is, that the courts now see "gay" as not a conduct, an act, a behavior, but an identity. Thus, while a law could theoretically, regulate or prohibit this behavior, a law cannot discriminate against this class of people.

Delusory, as I said. And disturbing.

Maryland’s legislature PASSED a law FOR gay marriage.
On January 1, 2013, the Civil Marriage Protection Act took effect, and same-sex marriage in Maryland became legal.

In my state — NY, A bill permitting same-sex marriage was passed by the state legislature and signed into law by Governor Andrew Cuomo on June 24, 2011; it took effect on July 24, 2011.

On May 2, 2013, Lincoln Chafee signed legislation making Rhode Island the tenth state to legalize same-sex marriage.

On 13 February 2012, Washington State Governor Christine Gregoire signed a measure legalizing same-sex marriage that would go into effect on 7 June 2012 unless a referendum with sufficient petition signatures were filed.

Washington Referendum 74 (2012) was successfully filed in opposition to this law and appeared on the general election ballot on 6 November.

Voters APPROVED the referendum, making same-sex marriage legal in the state of Washington. The law allowing same-sex marriage went into effect on 6 December, and the first same-sex marriage licenses were issued 9 December.
