I doubt this will rise to the level of a Capital crime, though I do think it should be one. That being said I agree largely with your analysis. For once Boehner may be playing his cards in a pretty clever way.
Once the vote is taken the Sgt At Arms can be told to find and arrest Lerner immediately. Boehner can call a press conference and announce the issuance of the Warrant and demand that Lerner turn herself in immediately or be declared a Fugitive from Justice.
Watching her do a perp walk into the Congressional jail would be a thing of beauty. The Pubbies are going to hold the House this November so the first order of business should be another Contempt vote so they can keep her criminal ass in the Congreessional jail for two entire more years.
