New Port Richey soldier says squatters won't leave his home.

NEW PORT RICHEY, FL (WFLA) -

When soldier Michael Sharkey was deployed to Afghanistan two years ago, he asked a friend to watch over his New Port Richey house. Sharkey and his wife are now living in Hawaii where he is currently stationed. They plan to move back into their New Port Richey home someday. But, right now they are fighting to get their house back.

They say strangers broke in, changed the locks, moved in and they refuse to leave.

"I want the people out," said Sharkey. "They're criminals living in my house."

Sharkey was shocked to find out that the Pasco County Sheriff's Office says it can't do anything about the squatters.

Ortiz says he has permission to be in the house, just not from Sharkey, the home's owner. Ortiz says he doesn't need a lease because he has a "contract." He described this contract as a verbal agreement with a friend of the soldier to fix up the home, in exchange for living there rent free. ---------------------------- Permission to be there, just not from the person who matters--the owner. So, I wonder who gave this fellow permission. Ortiz had a plan, but never bothered to check with the owner regarding whether or not said plan was acceptable. Does anyone else see something wrong here?

Isn’t there a criminal tresspass complaint that could be filed? Even if this dude actually has a contract (yeah - right), then it’s clearly invalid.

Hire a few unsavory types (with cash) to go and beat the tar out of Ortiz with baseball bats. If law enforcement is not going to do anything and we are quickly sliding into a lawless society, why follow the law?

When we were in Seattle, we saw an intersting Craigslist scam. People in Nigeria (probably) would identify a local home that was vacant, via for sale ads, etc. And then offer it for rent (or even for sale). Often the tenant would continue paying them rent, only to find out when the owner returned that they had no contract. Typically the rent was pretty cheap, too.

We found out about this when we found a place that was way too cheap. I discovered the practice when I googled the ad. It happens a lot where I live now (KY) regarding used cars.

There are civil actions that can be taken.

These situations are even worse in place like NYC, for example.

In NC, if someone moves on to a piece of land, sets up house - even builds, and their occupation goes unchallenged for 17 years, the squatters can establish a clear title. - When I was much younger, such an idea seemed untenable, but 17 years no longer seems quite so much time, any longer. LOL.

Physically throw them and their sh•t out of the house. Change the locks and buy a gun and pit bull. Let the moochers hire a lawyer to get their “house” back....

A neighbor of mine had a girlfriend. I hate this guy, a scumbag. Anyway, he pissed off his girlfriend so she came back one night when she knew he was away. Jumped the fence to his backyard, and stuck a garden hose through the kitchen window. Major flood issue; can’t live there until fixed. You got varmints, flush them out.

I think the Sheriff is wrong. ALL deals having to do with property must be in writing, not verbal. Ortiz’ contract is verbal and also is to fix up the house not to live in it. So, he is wrong on two accounts it is verbal and gives him no living rights on the property. He is committing criminal trespass and that is not a civil matter. Dam law enforcement doesn’t even know the laws anymore, but they sure know how to use force against innocent people. The old protect and serve is really out the window when these people who own the property need their property protected but the sheriff refuses.
