The family members had parked on the side of Nevada state Route 170, but the highway was included in the temporary closure of public lands, according to BLM representative Kirsten Cannon. Dave Bundy was arrested and cited with a criminal charge of refusing to disperse and resisting officers. Cannon said all public lands are closed within the designated closure area during the removal of the trespassing cattle.
Logue said Dave Bundy was taking pictures and recording on his iPad when he was asked by federal employees what he was doing. Logue said that Dave Bundy told the BLM workers that he was "exercising (his) First Amendment rights."
"He did not resist arrest, but they continued to beat him," Logue told KSL. "They put him on the ground and were standing on his head and had a dozen officers on top of him and dogs."
The Bundy family was asked to leave the premises after Dave Bundy's arrest. Logue said that there were snipers and uniformed men on the scene during the cattle impoundment.
"That's scary," Logue said. "I was angry, but there was nothing I can do. We were so outnumbered. With nothing but weapons of our cameras, we did our best at taking pictures. But when you're in that situation your mind is not thinking very straight."
Dave Bundy was released Monday afternoon. However, the Bundy family said they feel that their First Amendment rights were violated and that they were entitled to meet on state Route 170 to take pictures.

Amazing how swiftly they were able to destroy the notion of ‘private property.’ Most of the public had its head up its a$$, and didn’t see it happening. They though that something with a nice name like ‘bureau of land management’ would be really nice and benign.
Instead, it was just one way the gov destroyed the right to private property.

What do you expect the governor to do? They were grazing cattle on Federally owned land. And they haven't paid the grazing fees in 25 years while other farmers have.

Objecting to roping off an area the size of a small city for a turtle would be helpful too. Somehow I think 1000 head of cattle and a couple hundred turtles could co-exist. I've worked ranches with 100,000 acres (+ another 50000 or so if you include the BLM land we worked) and you can spend your life just finding the damn strays, much less worry about them out-eating the turtles, lizards, rabbits, coyotes, mountain lions, bobcats, illegal aliens etc...

So what. Someone should resist. Used to be free. Then the Enviros got involved and agitated for the fees to drive the ranchers off the land. And that land was considered only of value because the ranchers homesteaded it in the 19th century.

I don't know - maybe you know more about this case than I do. Please tell me when this land was owned privately? This case confuses me - it looks like the land was always federal land. The west was settled, after all, by the federal government granting land for free to hard-working farmers. I don't know when this particular land passed in to the federal government's hands. I'm not sure how this is a "private property" case. Thanks.
The land is not their private property and apparently never was. They quit paying rent - what do they expect?

Open Range isnt ended in Nevada. I just bought a section over there in 2013 and it was stated right in the documents. If you dont want livestock on your land its your duty to fence them out.
