BOYLE HEIGHTS, Calif. -- A family that claims a woman was frozen to death in a hospital morgue after she was prematurely declared dead can proceed with a medical malpractice lawsuit, an appeals court ruled Wednesday.
"This is one of the most egregious cases you'll ever see," family attorney Scott Schutzman told CBS Los Angeles. "This case keeps me awake at night."
The California 2nd District Court of Appeal overturned a lower court ruling that the lawsuit against White Memorial Hospital was filed too late.
Maria de Jesus Arroyo, 80, was declared dead in July 2010 after suffering a heart attack and was placed in a freezer at the Boyle Heights hospital. Morticians who received her body a few days later discovered that it was face down and the woman had a broken nose and disfiguring cuts and bruises to her face, according to court papers.

I have never heard of that. So that if she was still alive she would bleed to death and not be buried alive?
My father had a recurring dream of being buried alive. When he died, over 25 years ago, I insisted that he be entombed. His body is in a wall, in the cemetery ,in Paramus N.J. it’s like a high-rise burial condo.
My punch line was a follow up to your joke. It’s like I started in the middle. Anyway, his brother took his place and also fell out of the bell tower. People gathered around and a cop ran up and asked “Does anyone know this man?”

what a horrorshow!
i am pretty sure there are plenty of horror stories of people/patients who died in similar scenarios.and we have all heard about patients who were moved to that room where all of the recent deceased go to before they meet up with the undertaker(well someone like that),then they wake up from their coma surrounded by 12 “Assumed Dead” corpses.
