Arizona and Kansas can require that those registering to vote must prove their citizenship, and the federal Election Assistance Commission cannot stop them, even on the commissions own national voter registration forms, a judge ruled Wednesday.
The ruling is a significant victory for states that have pushed to tighten voting against potential fraud. It marks a setback, however, for President Obama and other advocates who have argued that stiffer voting checks tamp down on voter turnout.
Judge Eric F. Melgren ruled that the EAC, which Congress created in the wake of the 2000 Florida voting fiasco, cannot refuse to include Arizonas or Kansass demands that voters prove their citizenship.
The EACs nondiscretionary duty is to perform the ministerial function of updating the instructions to reflect each states laws, Judge Melgren ruled in a decision out of Kansas. The court orders the EAC to add the language requested by Arizona and Kansas to the state-specific instructions of the federal mail voter registration form immediately.
A spokesman for the EAC said they were reviewing the decision and it wasnt clear whether they would appeal.

That was the beginning. California passed Motor-voter in 1997. It has been all downhill since for California’s viability.
Requiring voters to be a citizen is a start, now require that they are alive.
After the 2000 election, the entire election systems should have been overhauled from top to bottom once and for all.
“Isn’t that also the function of the Obama administration, to minister (administer) the laws of the U.S. as written by the legislature?”
Surely you jest!! You can’t be series!
The legislative branch is sooo passé.
I hope they have Republican AGs and I hope they do.
VOTER I.D. ACROSS THIS ENTIRE NATION IS NECESSARY FOR THERE TO BE FAIR VOTING...
WE AS AMERICANS NEED TO DEMAND THIS
WAKE UP VOTERS...
I once knew an illegal alien who was proud of the fact that he voted in a state which make a point of not asking for id at the polls.
That counts down so slowly with my connection.
Wait . . .
What will be interesting is to see how many state and local public officials will not be able to run for re-election because they can’t prove the are citizens.
There is a citizen requirement to vote. There may not necessarily be a requirement for the elected official to be a citizen.
Democrats say identification checks could prevent some eligible voters from casting ballots... What happens when the time comes to prove citizenship to receive Obamacare ? Those who say asking for id’s to vote will keep people home. Obamacare requires the very same citizens by law to prove citizenship for Obamacare. Obama made it clear sign up or you will be fined.Dems will they say asking for an id to sign up for Obamacare will keep people from signing up ? They select when its ok to be asking for id’s and when it is not ok..They want both ways
