Half of all Americans believe that gay men and lesbians have a constitutional right to marry, according to a new Washington Post-ABC News poll in which a large majority also said businesses should not be able to deny serving gays for religious reasons.
Fifty percent say the U.S. Constitution's guarantee of equal protection gives gays the right to marry, while 41 percent say it does not.

Can states have gay marriage?
The 14th Amendment with that Equal Protection Clause is the problem with Gay Marriage and with the Roe decision.
Our only solution is to repeal the 14th Amendment.

The states can have gay marriage imo. In order to prohibit gay marriage the Constitution would have to be amended to prohibit such marriage imo.
Also, regardless that the corrupt media would have everybody believe that the Supreme Court decided Defense of Marriage Act (DOMA) unconstitutional, Section 2 of DOMA is evidently still in effect.

Powers reserved to the statesNo State, territory, or possession of the United States, or Indian tribe, shall be required to give effect to any public act, record, or judicial proceeding of any other State, territory, possession, or tribe respecting a relationship between persons of the same sex that is treated as a marriage under the laws of such other State, territory, possession, or tribe, or a right or claim arising from such relationship.
So regardless if a state allows gay marriage, states that don't allow gay marriage can basically ignore such marriages.
Makes sense. The spiritually insane elected the monstrosity-in-chief. Twice. A Christian nation would’ve never elected that scumbag. So now we’re a nation of majority scumbags. They wanted a president that reflected their own depravity, and they got him.

As the nation grew and changed with immigration and has fallen from a majority Christian and religious people the sinful issues have come forward and the Federal Court has gone were it had no grounds to go and is redefining the Constitution without a national state convention and ruling from the bench and altering our laws. What should be left up to the states is now forced on us all.
God knew we would get to this point someday. So did our founding fathers as Madison and Jefferson who wrote the constitution stated that only a moral and religious people could uphold the document and government and that the Constitution only worked with a Christian nation. Now that we are losing faith as a nation and losing our founding principles as a Christian majority the nation is coming unglued and failing. Government is failing, drugs and crime are epidemic, the economy and employment are failing, and we are ruled by tyrants that are regulating freedom into the prison cell and setting the sinful and evil that belongs in prison free to destroy society.
So, the ruler of the free world has lost its course and the world has now gone to hell as well. Soon it will all break loose and the 4 horseman will ride. This nation has lost is blessing from God, is pressuring Gods people in Israel to do the wrong things, and is tolerating a culture of sin and death. Americans of faith see this and pray for help while stocking up on the means to feed and protective themselves from the storm that is coming. Noah had an arc and we have Jesus Christ. Those without faith will fall with the evil that is coming.

So you do believe that states can have gay marriage, and you believe that when a family moves to different state, that their family no longer exists as a married couple with kids, or if an FBI agent or Marine is transferred to a different state, that they are no longer married.
America was once a free, relatively moral nation.

I think there's more to it than that. If they want to call themselves married, that's their business. But what they're saying is that WE have some obligation to recognize it. No one can have a 'right' if that 'right' puts an obligation on anyone else. You have a right to free speech, but that doesn't mean I am obligated to listen to you. You and you brother/sister can call yourselves 'married', but we as a society are not under any obligation to recognize it.

Yes, my reservation being that I don't know if English common law, which the Founding States had acknowledged in the Constitution and allows only for traditional, one man, one woman marriage, might possibly trump 10th Amendment.

What diffierence does it make? There are unmarried couples with kids everywhere.

They're still married in states that recognize gay marriage. But it remains that since the states never amended the Constitution to protect so-called gay rights, English common law helping to protect traditional marriage in Reynolds v. United States, the states are free to discriminate against gay issues, including gay marriage imo.
Note that Reynolds v. United States did not examine 10th Amendment-protected state powers since case dealt with a US territory.
It makes a HUGE difference for a family to suddenly find out that they aren’t married, when Microsoft transfers them from San Diego to Austin, Texas.
So military families marriages only apply to when they are on base, and federal employees become married/unmarried/married/unmarried when they transfer, even though by federal law and most states, they have a legal marriage.
Also immigrants who are allowed in the country as married, can become unmarried by states?
Is this why a black Marine with a white wife isn’t married in some states?
I have no doubt that gay activists / bullies will promptly instruct same-sex couples to consider such things when considering a move to another state. After all, not so long ago, gay activists were making sure that gay couples visited states that had decided to allow gay marriage so that such couples could be the first in line.
Rather than ignore the post, why not respond to post 38?
