PEOGA -- Charges have been filed against three people involved in a gun-pointing incident outside a home in northern Brown County.
On Feb. 19, the Brown County Prosecutors Office charged 20-year-old Jacob C. Phillips of Brown County, 25-year-old John Jacob Miller of Freetown and 18-year-old Samantha D. Artis of Columbus with Class D felony receiving stolen property.
The three showed up at the home Phillips lives in at 4011 Locust Grove Drive sometime before 10:42 a.m. Feb. 18.
Phillips had sent his father text messages that Miller and Artis had kidnapped him, and they were bringing him to the Phillips home, according to a probable cause affidavit.
Upon arrival, Miller tried to open the overhead garage door. As Miller put gloves on, Phillips dad, John, exited the home carrying a gun.
John Phillips then ordered Miller and Artis to the ground. When they refused, John Phillips fired shots into the air, and they complied. He held them there until police arrived.

Depending on the jurisdiction, warning shots can lead to charges of improper discharge due to lack of legitimate fear of bodily harm. If you think you must fire a warning shot, at least point the gun in a safe direction where the bullet will have a known trajectory.
An interesting question in this case. Do you kill the only people who may be able to tell you where your son is being held captive?

What goes up, must come down. Shoot the earth, not the air.
You don't fire a warning shot into the air unless you want to be charged for where that bullet lands.
Exactly as others have said. Probably would have been safer to fire the warning shots into the lawn. Not going to come back down on you or ricochet in grass and dirt.
And looking at the mugshots these 3 aren’t Obama sons this time, they’re screwed.
Fire warning shots into the ground , assuming everything isn’t paved. Bullets fired upwardly have a habit of returning to earth, sometimes on people’s heads.

The son was with the other two and had sent the father a text saying that the three of them were on their way to the father’s house.

If you shoot one of three assailants, isn't that a warning shot for the other two?
I've looked at the pictures, and I'm not convinced you're right.
