Rogers High student's tweet, Web boasts may draw felony charge (update)
Minneapolis Star-Tribune ^ | February 18, 2014 | Paul Walsh and Paul Levy

Boasts about sexual conquests on a now-deleted Web page could trigger felony charges against a popular Rogers High School student athlete and others, the latest twist in a swirl of accusations, comments and protest involving social media.

The furor in the Elk River Area School District on Tuesday transcended the dispute over a controversial tweet by the student and exposed the sexually explicit and often vicious exchanges that fill popular online pages created by students at many Minnesota schools. The anonymous posts include bragging messages, accusations and insults directed at students, teachers and others.

Rogers Police Chief Jeff Beahen said the “Rogers Confessions” page on ask.fm attracted many such “sexually charged” submissions. Some referred to a physical education teacher at the high school who was also the target of a Twitter exchange several days ago that led to a more-than-two-month suspension of senior Reid Sagehorn. Sagehorn, the 17-year-old captain of the school’s football and basketball teams, is accused of tweeting, apparently sarcastically, that he “actually, yes” was in an improper relationship with her. “It’s like screaming ‘Fire!’ in a crowded theater or ‘I have a bomb’ on an airplane,” Beahen said Tuesday of the possible felony charges, not long after supporters of Sagehorn held a protest outside the school. “If you say something on a very public forum, there are consequences. This young, innocent teacher is the victim here.”

"Let me ask you this, because this is what I'm wondering about in reading this story: is the appropriate remedy for damage to the teacher's reputation civil or criminal? Or both?"

Could be both. There are other postings that have not been identified by who yet that could also lead to charges and divided liability.

You equated the “crime” to rape. Don’t get pissy just because your words are now being used against you. You’re starting to sound just like the kid you think is to blame.

Yes, but he victimized himself as well as the teacher who has victimized no one. Hello?

You make a good point in that the article does mention possible charges against the people who set up the ‘confessions’ site in the first place. To me, that would be the more appropriate remedy for a charge.

Someone else had already made the charge against the teacher and Sagehorn was replying to it. Doesn’t make any of it right, of course.

What is being done to this kid is insane. To charge him with a felony is unconscionable.

Agreed.

I agree. The district is guilty of atrocious judgement.

Let me type this real slow so you understand.

I made an absurd hyperbolic remark to illustrate the absurdity of blaming the victim.

Hyperbole. Look it up.

Ever listen to Rush? Hyperbole is a common debating tool.

Sorry it went over your head and caused confusion.

You are simply obtuse. Be sure to stamp your foot hard when you make your absolute pronouncements.

It’s interesting the name of the student is prominent in every story about this, but the identity of the teacher is not. I wonder why? Usually it’s the other way around.

I’m very confused by this story, who reported this to the police in the first place is one question I have.

Apparently the "teacher" is a minor or something. The coverage of this story is bass-ackwards.

The teacher has a union backing her. The kid only has his parents.

Do you mean you made a comment like "Actually yes" to demonstrate the absurdity of being asked if you've had an affair with the teacher??

Point. Set. Match.

If there is still an open personnel case here the identity of the teacher is probably protected by state law.

OTOH, if he says he had a sexual relationship with a teacher, and he didn’t, he is falsely accusing her of a felony or two, according to the laws of most states, jeopardizing her job, career, and reputation, potentially costing her tens of thousands in legal fees.

Some people say false rape accusations of specific individuals should be felonies, and I tend to agree. The student did not say the teacher raped him in those words; very few boys would, but he did in effect accuse her of statutory rape.

Perhaps if our schools and legal system operated more by commonsense and less by rigid policy, this big mouth would face the administrative and parental consequences of his big mouth, and there would be an end to it.
