Ding-dong, Cap One calling.
Credit card issuer Capital One isn't shy about getting into customers' faces. The company recently sent a contract update to cardholders that makes clear it can drop by any time it pleases.
The update specifies that "we may contact you in any manner we choose" and that such contacts can include calls, emails, texts, faxes or a "personal visit."
As if that weren't creepy enough, Cap One says these visits can be "at your home and at your place of employment."
The police need a court order to pull off something like that. But Cap One says it has the right to get up close and personal anytime, anywhere.
Rick Rofman, 71, of Van Nuys received the contract update the other day. He was spooked by the visitation rights Cap One was claiming for itself.
"Even the Internal Revenue Service cannot visit you at home without an arrest warrant," Rofman observed.
Indeed, you'd think the 4th Amendment of the Constitution, which guards against unreasonable searches and seizures, would make this sort of thing verboten.

To no one in particular - Given the connections & behavior between the Federal Reserve, the government, and the financial institutions, anyone rooting for any of the three is mad.
Sign their agreements and live by their rules. It’s just like bounty hunting. The bounty hunter has a lot more freedom than the cops because the criminal signed away his rights when he asked you to bail him out of jail.

The BOR and the rest of the Constitution were written and
instituted as specific guidelines for the creation, function and most importantly CONTROL of government and it’s
actions. As such a private entity such as Capital One in
this instance is not covered by or subject to ANY of the
same restraints that government should be held to.
The Fourth Amendment does not NEED to say anything about
government entities....the entire document is in reference
to government.
I was once told by a government law enforcement official that a private citizens can beat a confession out of a perp and turn the evidence over to police and if they can go and get additional evidence they can make the arrest stick. Forced confessions are not allowed by government but no such restriction exists for private citizen. The private citizen would be liable for assault however. The case involved a family that had a child raped. They kidnapped the person that they knew did it and beat him until he confessed. The evidence gained from the confession showed he had done it and he was prosecuted.
Under such circumstances the issue of “duress” would be raised. I would be amazed if any honest judge would EVER knowingly allow evidence acquired from any forcible means regardless of who was involved to be allowed into evidence.

Pretty simple solution.
It came up in the 1980’s when I was the Vice-Commander of the Army-Air Force Center for Low Intensity Conflict. I helped participated in building “agony points” for Mr. Fred Friendly. He was an old guy then and produced a show called “In the Face of Terrorism” for PBS. Friendly at one time had been president of CBS News and the creator, along with Edward R. Murrow, of the documentary television program See It Now. He originated the concept of public-access television cable TV channels. The law enforcement representative from DOJ was the one that brought the point up about the confession. Another interesting point which was used was a plane sitting on the ramp hijacked by terrorists. The terrorists ask for a reporter and camerman to come aboard the plane. During the broadcast he asked Leslie Stahl whether she would do it and she said she would “jump at the chance” to get a great story. When she gets on the plane with her camera man the terrorist say they don’t think people are taking them serious. They have a military man on his knees and execute him while she and her camera man are filming. After Friendly presented this to Stahl he asked her if she still thought the media was just the eyes and ears of the public rather than complicit in the murder. You could have heard a pin drop as she was speechless.
I no longer have a “credit card”. I got rid of them back in the early 80’s. I have an American Express card and a debit card and I sign no such intrusive contractual garbage. I also will deal with trespassers in a most unpleasant way.
