Once, a long time ago, I slapped (and later kicked!) a cop (and was promptly arrested, rightly!!) who was attempting to arrest my boyfriend on the premise that said boyfriend was trying to attack me when clearly, said boyfriend and I were just goofing off. I don't resent the cop's arresting us, we were very young and stupid and drunk, and the cop was young and gung-ho.

However, I DO resent that the cop tore his own uniform after he'd hauled us off to jail, and lied on the police report, saying that I did it.

Happily, the judge somehow knew the cop was a liar and evidence fabricator. The judge nonetheless scared the hell out of me (scared some sense into me, I should say!), and the night I spent in jail was, overall, beneficial!! {^)

That said, I don't care if it IS Joe Biden's niece -- NOBODY should go to prison for hitting a cop. Jail for a night or two, okay, but prison for nothing more than taking a swipe at a cop? Those are some wildly messed up priorities. I call authoritarian control-freak bullsh*t.

It's standard procedure to accept going into rehab instead of jail time unless the crime was so severe it can't be forgiven. Personally, I'd rather have a family that can afford pay the bill to get a first offender off the streets rather than have that person subsidized in a prison.

It's up to the judge to make sure the rehab facility has a good track record, responsible programs, and isn't a country club.

Actually, in NYC that is exactly what would have happened to ANY of us for a simple assault of a police officer that did not involve the use of an illegal weapon or intent to kill or cause serious bodily harm or was tied to some other serious crime like robbery.
