Three weeks after Jahi McMath was taken out of Children's Hospital Oakland, a video claiming to show the girl's feet and toes responding to sensation has turned up on the Internet.

The video, posted on the "Keep Jahi McMath on life support" Facebook page on Sunday, showed a person's hand rubbing ice gently across the feet of a girl said to be Jahi, the Oakland teen who developed complications after tonsil, nose and throat surgery for sleep apnea and was declared brain-dead.

As stated above, I'm not sure what to think about this case, other than I can understand and sympathize with the family.

But, since the death certificate was brought up as a point, I think it should be clarified that, according to the family's attorney, the judge would not allow Jahi to be moved unless a death certificate was issued.

Here's the part where the lawyer explains:

Over my legal objections, Nailah Winkfield was cruelly made to go to the Alameda County Registrar of Births and Death to get a "death certificate" in order to move Jahi out of the hospital to a site where she could receive care. It required the intervention of the coroner because, at first, even the official at the agency didn't want to issue the certificate — after all, Jahi was connected to a ventilator and her heart was still beating.

The Terry Schivo debacle nearly destroyed my faith in the medical and judicial systems. It also validated my complete distrust of the MSM. The plug pullers insisted on conflating “persistent vegetative state” (Terry’s condition) with “brain dead” (which she was not). Yes, “brain dead” is dead — but, I can understand anyone doubting the medical establishment on the question.

Which is why I wonder if the 'undisclosed' location that they had her transferred was to a state without tort reform.

Shouldn't matter.

Lex loci delicti commissi.

Google "conflict of laws", "proper law," or "choice of law."

Any claimed negligence took place in California. Speaking generally, the standard rule is that, where an event happens in a state that gives rise to a claim of negligence, the proper law to be applied is the law of that state, including limitation on damages.

The family may not even be able to get jurisdiction over the hospital in another state.

I have no way of knowing how truthful that is.

The closest thing to what you describe that I’ve seen is documentation of caretaker mistreatment or negligence, completely independent of brain-death.

My personal observations on such matters have been of my maternal grandmother and my paternal grandfather. Neither one of them were declared brain-dead; my grandmother was in a coma on a feeding tube; both were treated well.

I have sat at many a bed side and because I chose not to give you the particular details is not an insult to you.

No, what’s insulting is this snark from you:

“apparently reading comprehension is not your strong suit”

Completely unnecessary and insulting. But that’s fine, I’m a grown man, I’ve been insulted worse. I give as good as I take, too.

I do not have any relationship with you other than sharing space on FR. That I chose to keep some personal parts of my life private is not a slam it is my choice.

Certainly, it’s your choice. It’s not particularly educational for me, but it’s absolutely your right to do so. So far I haven’t seen anything that backs up your claims, from you or from independent sources, but you can say whatever you want.

If you have never seen anyone die, it is instantaneous the second the soul leaves the body and very obvious.

My mother, my two brothers, and I were with my father when he passed. It was obvious the instant the soul left the body.

It was so obvious that the four of us were overwhelmed by it and almost immediately began talking about it in whispers, realizing the glory that is the soul.

Unfortunately, I have (at the bedside of my late beloved father). And, you are right - there's no doubt. That's why this video caught my attention. If what we see on that video is for real - whether it's the "Lazarus effect" or whatever the reason - I can understand the mother not believing what the doctors are saying.

It seems the care of this patient is being covered by private donations. (?) I haven’t heard if insurance or anything else is involved in payments - probably not.

Take anything Christopher Dolan said or says with a grain of salt.

Alameda County Superior Court Judge Evelio Grillo ruled on December 24, 2013 that Jahi McMath was dead as a matter of law.

It wasn't until January 3, 2014 that Judge Grillo said he wasn't going to let Jahi's family remove her body from the hospital without a death certificate and an autopsy.

The death certificate was a formality at that point; Jahi had already been ruled legally dead in court for well over a week.

When my father died and I witnessed his soul leave the husk of his body behind, his lungs were not being kept in motion by artificial means, so his heart was not left beating by artificial means.

I don't know what the situation was like for your loved ones, nor what affect that would have on being able to observe the soul leaving the body.

I also don't know if any of Jahi's family were present at her death to witness the soul leaving the body, but I haven't read anything leading me to believe they were.

Read #s 6 & 7 of this document .... doctor’s testimony as to what was going on with Jahi as of early January. This is a court document, not speculation.

Thanks.

It’s been three weeks since then. It’d be interesting to see the status now.

You act as if this girl is not dead dead dead. You are ignoring FACTS. The only bizarre part of this equation is your denial of reality. THAT is what is irritating.

How did I act like that?

You are letting visceral emotions impinge on your objectivity rational faculties.

Why are you affected so viscerally by the family, or others, not wanting to accept her brain death?

There seems to be something underlying your anger and emotion.

He claims to have “sat at many a bed side”, observed “[people] ‘kept going’ by machinery [with resultant] deterioration.... bones break, skin sloughs away from bone, bruising leads to muscle rot”.

He claims this is something he chooses “to do as part of [his] job”.

He “[tries to] help families understand but sometimes they will not or cannot.”

He claims for him “it is a mission of compassion that [he tries] to bring to the bedside of those who are sick and dying”.

He claims that “[s]ometimes it is at the bedside of those already gone from this veil [sic] of tears”.

He rails against “magical thinking” precluding “FACTS”.

Draw your own conclusions, but he sounds like an atheist hospice worker to me.

I read the Wikipedia link, it seems to say the Lazarus effect is a sudden reflex action of the arms, nothing about feet or response to cold stimulus.

I’ve actually heard mortician stories about the Lazarus effect, but I never knew it was called that. Scares the bejeezus out of the poor funeral prep noobs.

I apologize if I didn’t make it clear. I’ve had the unfortunate or fortunate depending on how you feel about life, responsibility of pulling the plug. In every case we gave it the best effort but the Doctors made it clear there wasn’t any hope. The Doctors aren’t ghouls who like killing people and I like to know the truth, not sugarcoated. So in one instance, we pulled the respirator and the person lived for several hours and then like a switch had been thrown, they and everything that made them unique was gone. I am continually amazed at the spark of life that God created and when it’s gone it’s gone. And my beliefs are that they are in a better place.

No and I am done with your silliness. I have no underlying anger or emotion. Deny facts all you want. It matters not to me.

Angry old fat man speculated that you are atheist.

I got the same impression.

Your irrationality, eg thinking I denied any facts, based on a clear anger reminds me of many strident atheists on other topics.

"You are letting visceral emotions impinge on your objectivity rational faculties."

Visceral emotions.

Yet you were the one throwing around accusations that Freepers are somehow "invested" in the girl being "DEAD DEAD DEAD." (Your caps).
