SAN DIEGO, CA The man who filmed the arrest of an illegal immigrant finds himself in trouble with the law. Jose Guzman says he caught the incident on camera because he felt authorities were going to far. However, authorities arrested him because of his camera work, Allison Ashe has the report.
This is the video that's causing all the ruckus. It shows a Border Patrol agent on top of an undocumented worker as another man holds his feet.
You can clearly see the agent jabbing the man's ribs with his knee and hitting him.
It does not show what the Border Patrol says happened first, the undocumented worker striking the agent several times
Mitra Ebadolahi, ACLU Border Litigation Attorney, "You know it looks like he is not resisting at this point.", said these actions appear to be excessive force, but Border Patrol brass says otherwise.
Pete Vasquez, Border Patrol, "What the video doesn't really show as you're looking at the individual's back, you can't see his hands, what he's really doing with his hands, And he is still actively resisting and trying to get up."
Now a new twist, after Border Patrol agents seized the cell phone video shot by a man who didn't want to be identified and he was arrested for violating his probation.
He was arrested after refusing to help Border Patrol agents locate another undocumented worker who got away.
Erica Garcia, girlfriend, "They asked him to call the guy and ask him where he lives, I think like to kind of set him up, but he didn't want to do that cause it was his coworker and he didn't want to get involved in that.

If you do not help catch them then deport his sorry butt.
If they can beat up an illegal alien who is defenseless, they can beat us up and get away with it too.
We're going to start seeing this more and more, law enforcement seizing video taken by bystanders, which could be your camera or your phone.

Why? Back when cops actually could get away with beating up criminals, they didn’t get away with beating up regular Americans.
Rodney King led police in an extremely dangerous chase through residential neighborhoods, appeared to reach for a weapon (didn't have one), resisted arrest even to the point of throwing multiple officers off himself, took two taser hits, and rushed an officer before the baton beating started. Of course, the video conveniently didn't show any of this. Not saying everything the officers did was right, but there definitely was a 2nd side to the story that got shadowed due to fear from a misled public.
Why bother beating up? Shoot to kill.
Point taken, but the two are not the same to me. These foreign invading sonsabitches have no rights in my mind. Patting them on the butt and sending them home accomplishes nothing.
There was a case at Duke hospital where a young, ILLEGAL ALIEN girl was given organs with the wrong blood type. I cannot imagine that she or her country was paying for the surgery but when she died, her atty sued for millions and was asking for citizenship for the parents. Never heard the outcome.
And, why are they treated better than Americans here?
God gave all humans certain fundamental rights.
If you want to get rid of illegals, follow the law to do it. Extra-judicial punishment ISN'T a conservative position.

There is no such thing as an “undocumented immigrant”. There are immigrants - those who’ve followed our law, and there are foreigners. Foreigners present in the US illegally are “illegal aliens”, their documents are in the foreign country.
Worse than that, the Patrol was possibly asking a person on probation to violate the terms of that probation by associating with a known felon.

Back then cops were PEACE OFFICERS. They didn’t swagger around in paramilitary garb and use military weaponry against civilians. It was a different world. I knew. I was alive back then.
If we got serious, people like this would be a lot fewer and less successful. We need a PHYSICAL Barrier and we need to get tough with the Damn Mexican GOvernment for encouraging this, and with American employers who use these people knowlingly.
Mexico IS the the problem: about 63% of illegals are Mexican.

The video clearly shows the illegal alien was not complying, was holding his hands close to his body and not allowing the Border Patrol Agent to handcuff him.
The Border Patrol Agent was using appropriate force to get the illegal alien to comply and allow him to be handcuffed.
The illegal alien was hardly ‘defenseless’ as we (and the Agent at the time) have no way of knowing if the illegal alien had anything in his hands.

Forcing an illegal alien criminal to comply is not extra-judicial punishment.
Thanks JRF, but I don’t need your lecture on what conservatism is. We have been FAR too lenient on these invaders and that’s one reason the problem still exists. Best solution is better walls/fences, but there need to be serious consequences for those caught within. They are flooding across with relative impunity, and it needs to stop.
