Wendy Davis Sued Newspaper for Damaging Her Mental Health, Future Prospects

The story of Davis' unusual lawsuit was recounted by the San Antonio Express News Monday. The blog Sara for America has highlights:

Davis said in her lawsuit that the newspaper ran “a series of contrived and false news stories and editorials…with malicious intent.”

The lawsuit said “defamatory and libelous” remarks were made to inflict emotional distress and to deny her rights to free speech, assembly and association.

It said that “Davis has suffered and is continuing to suffer damages to her mental health, her physical health, her right to pursue public offices in the past and in the future, and to her legal career.” She sought unspecified damages, including “significant exemplary damages.”

According to National Review's Andrew Stiles, "The suit...was quickly dismissed by a district-court judge, who sustained all of the defendants’ objections, largely on the grounds that Davis had failed to present legitimate evidence to support her libel claim." She appealed it all the way to the Texas Supreme Court, losing at every turn.

Indeed it is. I'm sure it was the same sugar-daddy who paid for the college loan. It's not the only work she's had done, either. Somebody posted a picture of her from the high school yearbook, and she was pretty fugly. Lots of work done on the face.

Just about anybody in the GOP field will beat her easily, provided they don’t say something stoopid about abortion or rape. Even the TX press is willing to report how whacked out she is. The only press eyes with stars in them are in Austin and NYC.

Really, if any other Rats enter the race she won’t make it out of the Primary.

While that may be, a 12 million war chest isn’t and it will buy a lot of “influence”. Texas Reps can become complacent, we need to run a full court press on this creature

Never did I say anybody can afford to be complacent, and you’re right, a $12 Million warchest can do a lot. Ask John McQueeg, who used his Presidential contributions to grind down a conservative challenger in his most recent AZ Primary for Senate. Notice to anybody who contributed to McCain for President ‘08: You helped defeat a real conservative challenger to McNasty. You did far more than Sarah Palin to drag the old fossil over the finish line.

Notice I put in a proviso the GOP candidate has to avoid saying something stoopid. It’s not called “The Stupid Party” for nothing!

I’m not kidding. I’m also not determined to rationalize anything about Wendy Davis. The point is not letting our side become focused on this issue when there are real political issues to slam her.

We agree. These things are scandalous or at least character illuminating. But the same can be said for any politician or public figure, right or left or in between. IMO the main problem on our side is we don’t have control of the media as the dem/left does. We don’t have control of education as the dem/left does. We don’t have control of the religious institutions as the dem/left does. We don’t have control of the judicial system as the dem/left does. Major problems.

Chris Christie is my Governor and I voted for him and would do so again. He’s far better than any Governor we’ve had here in the last 30+ years. I’m from PA and thought Casey was ok on social issues but horrendous on fiscal but he was a decent guy (unlike his son, the Senator).

I also voted for Romney in the General because I wasn’t voting for Obama or throwing away my vote by voting 3rd party or not voting at all.

The last thing I want is another Bush in office (or a Clinton) but I would gladly vote for the former over the latter. We aren’t a dynasty based government and I wish we didn’t have political royalty.

Again, I don’t get butthurt by politicians on either side since I don’t worship them. We hire them to do a job and they should do that job. Most of them don’t. But, the left/dems always support their people while we don’t and we lose. And, we have allowed them to take over all our Institutions. This is what we get.

Don't necessarily like to come to the defense of MSM newspapers, but if what the newspapers reported about Davis' background is the truth, then none of the injuries that Davis claims matters in determining the case. The truth is an affirmative defense in a defamation (libel or slander) case. If Davis can't under any circumstances show that the newspaper was not telling the truth, the case has to be dismissed. That holds for all defamation plaintiffs, whether public figures or just faces in the crowd.

Either way, she drove herself right into a corner with that lawsuit. If her allegations are even partially true, then she's not fit to be Governor of Texas. If they're not true, then she's a congenital liar who's even less qualified to be Governor.
