The contract would be negotiated and awarded by a DoD contracting agency, not by DOJ.

Doesn’t matter, this is the era of hope and change; laws, contracts, normal business practices, normal bankruptcy rules - none of these apply. It is whatever El-Presidente decides to do that counts.

In this case, if DOJ were to award a contract, then they would have to pay it. That would never happen.
