You have the RIGHT to record the police and the police are not allowed to attempt to confiscate your phone/recording device and can be charged with obstruction/destroying evidence should they erase or attempt to erase the recordings.

It’s worth noting it’s very difficult to prove officer malfeasance if they’ve destroyed the evidence. Make destruction of evidence by jackboots a crime all you want, and cell phone cameras will continue to be destroyed under the jackboots.
Technology is helping. There are apps available to automatically upload photos and videos to the cloud real-time. The last thing on the video will be the cop as he’s smashing the phone.
The cop clearly knew that. But he threatened the guy with a search for warrants. Intimidation was the order of the day.
