I will grant the author the possibility on every point except for one.

The act as passed is unconstitutional. Chief Justice Roberts should know that his job is like that of an umpire, calling balls and strikes. Leave the politics for the other branches.

DITTO. Court’s job is not to scheme indirectly to declare a law null. If CJ Roberts actually decided strategically to kill a law by declaring it legal and let it die of natural causes should be impeached. Our country has no time for such nonsense and cost. If true how many Americans must suffer before the law dies of financial implosion. IMHO CJ Roberts was blackmailed into changing his mind due to the two kids he adopted under questionable legal circumstances. If Obama does not blackmail him the Health Insurance industry will.

This suggests amazing foresight, but it wouldn't be the only instance.

I don't buy that Roberts was setting a trap. I believe he was just making a whole series of truly unfathomable decisions.

I totally agree.

Also, it is not clever to uproot the medical coverage of millions of Americans, and the payment system to all of our medical care providers, in a game of Gotcha.

What our country is going to experience this coming year is beyond the imagination of too many Americans, including political commentators.

I agree that it is not the job of Roberts to involve himself
in politics. That is also true for the rest of the justices
but try getting the lefty judges to act accordingly.

If what the author says is true it doesn’t take much
imagination to anticipate the Democrats might very well
blame Roberts for failing to save them from their own
foolishness. From there instead of a “let us all start
over again, together” attitude the libtards will push
the single-payer BS which is what most of them wanted
in the first place. Then where will we be?

His job isn’t to help the GOP or the democrats. His job is to evaluate the cases brought before the court based upon the law and the Constitution.

I agree that the ACA is unconstitutional. I'll bet Chief Justice Roberts does, too. But the question at the time involved whether or not the ACA was unconstitutional on the basis of the very specific legal challenge that was brought before the court.

Just because the U.S. Supreme Court found the individual mandate in the ACA constitutional on those grounds, it didn't mean the ACA was constitutional in its entirety. There was always going to be further legal challenges based on different legal arguments that could not be brought at the time because they related to provisions of Obamacare that hadn't even taken effect yet.

I don’t think you can consider something the supreme court decides as unconstitutional.

That’s their job, they are the final authority (besides ball and musket).

You are exactly right. Roberts is supposed to determine constitutionality, not play politics. But at the same time, the authors reasoning is as convoluted as Roberts’ reasoning was. I don’t believe for a minute this is what happened.

You are exactly correct. I am so sick and effing tired of those on here who try to justify Robert's un-constitutional act as somehow a "stroke of genius" to un-do Obamacare.

Fact is, Roberts acted in an un-constitutional way when he re-wrote the legislation (which the USSC is not permitted to do under the Constitution) and called it a tax.

Roberts was too pre-occupied with "what will the public think?" and the "image" of the court, rather than doing his Constitutional duty.

I hope Justice Roberts burns in hell one day for what he did to this country.

ANYONE who thinks Roberts "put it back on the people" to vote out those who voted for Obamacare is kidding themselves.

ANYONE who thinks the Stupid Party (Republicans) really want to unddo Obamacare is kidding themselves. They'd much rather have it as a weapon to beat up Democrats with than actually repealing it.

We are STUCK with Obamacare (and eventually, single-payer Government Run medicine) thanks to Justice John Roberts.

I hope to live long enough to be able to piss on his grave when he's dead and buried.

Absolutely and in the coming years Roberts will be famous for his idiotic vote and his attempt to destroy American justice. This man will eventually go down in history as one of the WORST justices in the history of the Republic! All for this stupid vote to go along with the Liberal idiots of the time.

This will eventually be overturned or so changed that it will not be recognized as the bill of today! Shame on you Roberts for being the asshole of all time on the high court.

Due to existing rulings on the books, it was indeed constitutional.

but, due to this ruling, it can never be again....

even if fubocare is overturned, and it will be, the ruling still stands....

the commies ans socialists are toast, and even that old bag ginsburg saw it...

I said it the day after I read the ruling that this ruling was the best thing that has happened to constitution loving americans in over 80 years, only to be called a traitor by most people on this site....

why do you think fubo and the lib republicans are delaying implementation?

Out of the goodness of their hearts?????

The tax ruling that all here disagreed with is going to be the undoing of this, and the ruling will still stand...
