Cops to Use Portable Drug Test at New Year's DUI Checkpoints

Authorities plan to crack down on impaired drivers – either drunk or under the influence of drugs – using new DUI technology this New Year’s holiday.

A state grant will allow Los Angeles police officers to expand its use of swab testing at DUI checkpoints and jails to check for narcotics use, city officials announced at a press conference on Friday.The grant comes at an opportune time as authorities said they are seeing more incidents of motorists driving under the influence of marijuana and other drugs.

Los Angeles City Attorney Mike Feuer said the prevalence of medical marijuana dispensaries throughout Los Angeles have heightened the number of impaired drivers in the city.

So far as I know the “implied consent” that comes with your drivers license only applies to alcohol. Not to cheek-swabbing you for an endless number of substances (nor your DNA).

In most states implied consent applies to a "chemical test for intoxication". That would include drug or alcohol intoxication. (which makes sense because alcohol is just another drug) But, in my state at least, a "chemical test for intoxication" is limited to a blood, breath or urine test. Thus, swabbing for saliva or cheek cells is not included and you are not obliged to consent to such a test.

LOL. The police state will expand it to reach whatever they want you to consent to. Can't wait until they start claiming the pernicious doctribe applies to warrantless house to house searches for ___________.

This would be the equivalent of a DUI test that had only a Positive, or Negative result, and no numerical value so demonstrate level of intoxication. THC can test positive for days after you are under the influence. It would be like getting a DUI for the cocktail you had 2days earlier. With other drugs you would have problems with false positives as well. If you had a legal narcotic prescription, or for medical MJ what happens then?

these portable units are rampant with falso positives and maintaince inadmissiblity at trial issues.

The goal is to achieve plea bargains by financial oppression.

ie taxed to death.

that is why ANY pot use whould MANDATE surrender of a driver’s license.

perscription pot = no driver’s license, period.

The “doctor” who writes the perscription should be mandated to report the use to the state for the state to issue an administrative suspension.

There is plenty of blame to go around. None of it would be possible without the inroads encouraged by the supporters of the war on drugs though.
