Great question.

I'd like to hear Chief Justice John Roberts explain how the “penalty” is a tax since, essentially, it is almost uncollectable.

Possibly one technicality gets him off the hook.

People who get the Earned Income Tax Credit are “paid” via a tax refund.

So, some small portion of our population, less than 10%, do have exposure to the “penalty tax.”
