How To Skip Out On Obamacare Without Being Fined

I will be submitting a new W-4 form to my employer. At the end of next year I will not be owed a tax refund from the federal government. As a patriotic act of disobedience, I am proudly refusing to purchase any health insurance. This would mean that I will be subject to a fine of 1% of my total income (2% the following year, 2.5% thereafter). The awesome thing about that is unless you are due a tax refund, the government will never see a dime of that money.

My choice to not buy health insurance is a choice many people are going to make, either to protest, or once the ObamaCare website is properly up and running and they get a glimpse at the increased cost of the monthly premiums under the Affordable Care Act. During his radio show recently, Rush Limbaugh went into detail about all of this:

Anyway, [my accountant] said to me that, according to the law, the only way that the government can collect the fine or penalty for you not buying insurance is if you are owed a tax refund. If you do not owe a tax refund, they cannot go into your bank account or anywhere else and get that money. Now, the sad thing is that most people file their taxes to get a refund ’cause they think they’re screwing the government, and they’re not. …

Therefore, the only way that they can collect the penalty or the fine is by taking money from your refund. If you are not owed a refund, they cannot get money from you. They can’t issue a lien. They can’t garnish your wages. They can’t use any of the normal procedures available to them if you owe them money, even though the Supreme Court has said it’s a tax. So for those of us — I mean, folks, I’m in fat city. I’m in fat city because I always structure to where I owe money. Well, not entirely. There have been years. But if you structure your taxes so that you do not get a refund, you do not have to buy insurance and you do not have to pay a fine ’cause they can’t collect it from you if you don’t have a refund due.

And that is just another nail in the coffin of Obamacare imploding on itself.

Limbaugh also highlights that in order for ObamaCare to be successful, the program must coerce a few million young, healthy suckers into paying for something they don’t really need. All I need is a catastrophic plan in event the unimaginable happens. Unfortunately, Obama has banned affordable catastrophic plans and is utilizing the mandate as a way to force us into paying for services that we don’t all need like maternity, vision, dental, mental health, and drug and alcohol treatment.

As many as 20 million people could lose their current health insurance coverage because the coverage they are currently happy with has been outlawed under ObamaCare. These ObamaCare victims are certainly going to face higher premiums which they might not be able to buy, or just don’t believe are worth the potential of a 50% to 150% premium increase with a higher deductible.

Remember that you don’t have to pay a fine if you legally ensure that at the end of the tax year you are not owed a refund from the federal government.

Actually I am not expecting it to matter whether you are D or R unless you are in the tiny elite group who will be taken care of. The rest of us peons will simply not have access to REAL healthcare. It won’t be just a matter of long waits, there will be no care even when the waiting is over. There may be a place to go with people who are called doctors, nurses, technicians etc. but it will all be a pretense, your chance of survival outside the system will most likely be higher than inside the system. There may be ships anchored off shore where people with money can get real care and there may be far more “medical tourism” but instead of people coming from Canada to the USA for surgery as in the past, well to do Americans will be going to India, maybe even Mexico to obtain real medical treatment. What is available to the average Joe in this country will be enough to make you consider asking your veterinarian to treat you as well as your pet. That is of course provided that the vets don’t go broke in the poverty economy being created. So called “alternative” medicine should flourish.

This is all designed solely for the purpose of collapsing the existing system so that there is an excuse to finally go to “single payer” and once that is in effect the days of quality health care for working people or for people on welfare, anyone other than the wealthy, will be over. The wages of stupidity are bitter indeed and all of us are about to be paid for the stupidity of the dreamers who kept voting for handouts.

Those who thought the D’s would fix what the R’s messed up were expecting an angry pit bull dog to save them from a house cat and anyone who thinks the R’s will fix what the D’s messed up is expecting the house cat to save them from the pit bull.

They will have to change it of course.

Probably when the first numbers come in, and they are way short of funds to keep the scheme afloat.

They will say it’s because people aren’t paying their “fair share” and they need to change the law.

Actually it will simply be because there are too many freeloaders.

That's why it will be important, if possible, to elect people to the House and Senate who are committed to first defund, and then repeal Obamacare, and will not go along with a piecemeal patch up.

I would think the problem with allowing your utilities to be shut off is that it will cost more to have them turned back on than what the fine is.

2. Adjust your withholding and take the maximum number of deductions so that at the end of the year, you don't get a refund. Rather, you PAY. Ideally, you should set your withholding so that you OWE as little as possible, but do not get a refund.

Nope. Tried that years ago so that instead of getting a refund I could send a payment at the end of the tax year. The IRS sent a letter to the employment agency and instructed them to change the forms they had (W-2?) so that I had to have part of what I was compensated with-held. Did not matter what I claimed, they were to withhold and instruct Me to file for a refund instead.

And no, I could not afford a "Lawyer" to contest it.

Made that call (did the math) thirty years ago when I realized I was paying 10k per year in premiums, plus deductibles. Decided to just pay for care as needed. With the occasional bump for broken bones and c sections, we spent maybe $100k over that time frame, saved, easily $250k in premiums an deductibles, net. Yeah, I know, it was a role of the dice, but it worked out, as it would for he vast majority. One of my doctors did the same thing.

As to “tax refund”, never understood willingly loaning the feds interest free money. They got what they were owed, not one penny more, at the last possible minute.

The IRS will simply apply your withheld taxes to the penalty *first*, and then come after you for the balance of *taxes* owed using their full enforcement arsenal.

Exactly. The IRS could do this by administrative fiat - wouldn't need the Treasury Department, Congress, or Obama to even get involved.

With tens of millions of people rationally taking this same action, instead of having hundreds of billions in free loans every year from taxpayers, the federal government will go to having a hundreds of billions of money owed it every year. Simply another predictable outcome of KommmieKare.

Why should one EVER have a surplus? It’s extremely easy to under withhold.

Sometime in the future someone in the senate or congress will point out how much in fines is unpaid and there will be a push for legislation to collect the arrears PLUS INTEREST via wage garnishment, property liens, confiscation of savings, etc.

that would be ex-post-facto...illegal, can't be done...they can't make something illegal retroactively..

If it isn't in a law yet, it will be.

Look for it to get slipped in the next 2400 page bill that nobody has read. Or, maybe it will just he in another budget omnibus bill agreement that nobody has read.

Whatever.

Whomever thinks they are going to get away with not paying their "tax" is going to find they are dealing with the IRS, not mom and dad. They won't be allowed to walk away from those levies - or the interest and penalties. They are going to pay through the nose and whatever loopholes are presently there will be quickly plugged as Fedzilla's deficits continue to crunch.

I have actually never filed for 1997 - 2001 under protest. however i did pay all of my taxes owed. i did not file any 1040. and my ss report shows zero for those years. my interpretation of how the current socialists are enforcing the law is: you are required to file if you expect a return. i did not expect a return.

You can be penalized for under withholding, so you need to plan it out to as close to ZERO Taxes owed at the end of the year.
