Ga. National Guard will ignore Pentagon directive to recognize same-sex spouses

Updated at 5 p.m.: The Georgia National Guard this afternoon indicated it intends to ignore a directive from Defense Secretary Chuck Hagel and will continue to send same-sex spouses of National Guard personnel elsewhere for benefits guaranteed by the Pentagon.

“The State of Georgia does not recognize same sex marriages and is not authorizing the Georgia National Guard to process the applications for same-sex married benefits at state facilities. Any personnel seeking to apply for same-sex married benefits will be referred to federal facilities.”

The statement was in response to this piece by the Associated Press:

Defense Secretary Chuck Hagel on Thursday sharply criticized U.S. states that are defying the Pentagon by refusing to allow National Guard facilities to issue ID cards that enable same-sex spouses of military members to claim benefits.

"Not only does this violate the states' obligation under federal law, their actions have created hardship and inequality by forcing couples to travel long distances to federal military bases to obtain the ID cards they're entitled to," he said.

Hagel said this is causing division among the military ranks.

In Oklahoma, for example, Gov. Mary Fallin ordered her state's National Guard to stop processing requests, making legally married gay couples apply for benefits on federal facilities like Tinker Air Force Base. Oklahoma in 2004 approved a constitutional amendment prohibiting giving benefits of marriage to gay couples.

It was not immediately clear what legal authority Grass has to force the states to change course.

Hagel said he instructed Grass to meet with the adjutants general from the nine states where the ID cards are being denied at state facilities. He said those adjutants general, who work for their states' governor, "will be expected to comply" with Pentagon policy on this issue.

If you like your sovereignty, you will be able to keep your sovereignty. Period.

The more this Federal Government debases our traditions, morality and rights (and I do mean STATES’ RIGHTS), the more they can expect kickback from us.

I am supportive of my state, and my National Guard here in not appeasing to the Federal Government in a matter in which they have no business inserting themselves in.

Just keep it up, Fed. You might find you have a few (or many, many more) National Guard units who WON’T have your back when the SHTF.

EXECUTIVE ORDER 10990 allows the government to take over all modes of transportation and control of highways and seaports.

EXECUTIVE ORDER 10995 allows the government to seize and control the communication media.

EXECUTIVE ORDER 10997 allows the government to take over all electrical power, gas, petroleum, fuels and minerals.

EXECUTIVE ORDER 10998 allows the government to take over all food resources and farms.

EXECUTIVE ORDER 11000 allows the government to mobilize civilians into work brigades under government supervision.

EXECUTIVE ORDER 11001 allows the government to take over all health, education and welfare functions.

EXECUTIVE ORDER 11002 designates the registration of all persons. Postmaster General to operate a national registration

EXECUTIVE ORDER 11003 allows the government to take over all airports and aircraft, including commercial aircraft.

EXECUTIVE ORDER 11004 allows the Housing and Finance Authority to relocate communities, build new housing with public funds, designate areas to be abandoned, and establish new locations for populations.

EXECUTIVE ORDER 11005 allows the government to take over railroads, inland waterways and public storage facilities.

EXECUTIVE ORDER 11049 assigns emergency preparedness function to federal departments and agencies, consolidating 21 operative Executive Orders issued over a fifteen year period.

EXECUTIVE ORDER 11051 specifies the responsibility of the Office of Emergency Planning and gives authorization to put all Executive Orders into effect in times of increased international tensions and economic or financial crisis.

EXECUTIVE ORDER 11310 grants authority to the Department of Justice to enforce the plans set out in Executive Orders, to institute industrial support, to establish judicial and legislative liaison, to control all aliens, to operate penal and correctional institutions, and to advise and assist the President

EXECUTIVE ORDER 11921 allows the Federal Emergency Preparedness Agency to
develop plans to establish control over the mechanisms of production and distribution, of energy sources, wages, salaries, credit and the flow of money in U.S. financial institution in any undefined national emergency. It also provides that when a state of emergency is declared by the President, Congress cannot review the action for six months.

And you though you were protected by the Bill of Rights? Well, yes, if Congress ever chose to review and nullify any of these orders -but they don’t so they stand as the law of the land.
