CA:Man Fatally Shoots Home Intruder: Police

A Yorba Linda resident shot and killed an intruder who broke into his home early Sunday, authorities said.

The incident happened about 3 a.m. in the 5000 block of Wendover Road, said Orange County Sheriff’s Lt. Jeff Hallock.

The wife of the man who shot the intruder called 911 saying he had a man at gunpoint, Hallock said. The men had been arguing, deputies said. There was a baby in the house.

Deputies said they were looking into what, if any, charges might be filed against the man who fired the gun, but said it appears to be self defense.

Neighbors, meanwhile, were shocked.

A homeowner can defend his home, even in California.

The Police haven't finished with this yet.

They still may charge him.

Exactly. If you have to shoot, you want the police to hear one and only one story - yours.

This guy's family was at home... I wouldn't hesitate. Someone breaks into my home while my family is there I will shoot first, and never ask any questions. If I'm the only one home I may, may give the intruder one and only one chance to lie face down with their hands behind their head. If it is more than one intruder, I fire immediately on everyone, regardless. I will not risk my life on some "poor misunderstood victim of ..." BS. You break into my home, you are a threat and you place your life at risk.

Yeah, that’s the ticket! Looks as though the Sonoma County Sheriff’s deputies who killed the 13 year old with the plastic AK thought the same way.

My 9mm doesn’t make much noise. The 1911 has a satisfying sound. The AR charging handle has a certain note of finality to it. Nothing beats the sound of the Mossberg 12 ga pump though. As the old saying goes, “that says ‘get out’ in any language.”

Seriously?

You want to compare a 13 yr-old with a fake gun out in the open with someone who broke into a house with a baby and a wife in the house?

You think these two scenarios equate with each other?

You completely misunderstood my comment. I was commenting on “shoot to kill.” Your comment was to the effect that “dead men tell no tales,” and evidently that’s what the cops decided too. OTOH, how is a 13 year old child any less “valuable” than a “wife and a baby?” He was someone else’s “baby,” and he was murdered! Someone breaking into your home deserves to be confronted and shot if he poses a threat, A child walking down the street with a toy gun not threatening anyone, does not!

If you go to the link, the story at this time is that this was a straight-up burglary. The suspect broke the rear sliding glass door, was confronted by the homeowner (who “argued” with him, aka tried to avoid shooting). Said homeowner was then forced to open fire.

If those facts are correct, there’s no way the OC DA would ever file.

Only way the homeowner gets charged is if there’s more to the story...ie, they were Walter White and Gustavo Fring or some such nonsense. But so far, this looks like a clear-cut case of self defense.
