Obamacare settled law? Try enforcing it

Liberals desperate to preserve the Affordable Care Act are doing what they frequently do when their beliefs are about to collapse. They declare matters “settled” to stifle debate and end conversations. From climate change to healthcare, their prize projects are settled simply because they say so. Everybody else should be quiet and agree with them rather than have honest debates.

To understand why the Obamacare debate is anything but settled, liberals should heed the words of former Democratic President Andrew “Old Hickory” Jackson.

In the 1830s, the Marshall Supreme Court ruled against Jackson on a matter involving gold found on an Indian reservation. The issue was supposedly settled, until it was not. Jackson made his declaration public and emphatic.

“John Marshall has made his decision; now let him enforce it.”

President Obama has taken Jackson’s words to an art form. When Obama dislikes laws, he simply disobeys them. He substitutes his own moral conscience for blackletter law, discounting others with different moral beliefs.

He disliked the Defense of Marriage Act, so he stopped enforcing it.

He disliked laws requiring that illegal immigrants be deported, so in many situations he stopped enforcing them.

With Attorney General Eric Holder running a highly politicized Justice Department, laws are enforced selectively. Overt voter intimidation acts by the New Black Panthers against white voters yielded no prosecutions, a disinterest in enforcing the law equally.

Even Obamacare saw Obama engage in unconstitutional actions after the law was deemed constitutional....

it might, but there are two things to consider in a IRS-run scenario - one, the government won’t throw homeowners in jail for refusing to pay fines/levies- they’ll just confiscate real property instead. As for defunding agencies, I doubt the IRS will allow themselves to be defunded without a fight, especially once they possess intimate information about every citizen.

Craziest law ever written that has change built into it.

Gives the Secretary of health and Human Services unlimited powers to make regulations to her own desire.

Depends upon what you think "work" means. It doesn't take a lot of imagination to posit what this crew might do.

The one thing you can be sure of in this fiasco is that the IRS has made sure that their computers can attach the paycheck, freeze the ATM and the credit cards. Then it's a bench warrant for arrest, anywhere, in every police computer system in the land. Local jails would start filling. Some sheriffs would hold them; a very few would refuse. This allows concentration of said storm troopers to arrest said few sheriffs and/or judges who refuse to hold them. And so on... Whither self-preservation from that point, who knows? Maybe people would start paying fines but I doubt it. My bet is they'll be buying food. That would cause general panic.

TSHTF goes downhill from there, one address on the database at a time. As long as the MSM never reports it and the Feds are willing to shut down every web site that makes a fuss early on, few who could do anything about it would know the extent of the protest. Just cut the power, roads, and water to recalcitrant cities and regions and watch them starve into chaos.

Remember: to these thugs there is no 'unacceptable' level to which they won't descend if they think they can get away with it. It's not money they crave; it's power, for revenge. Think of your average ghetto riot, with people wrecking their own homes and stores. Civil disobedience would be welcomed by this group, depending upon their assessment of their own competence to get away with it. The problem with this crew is that they are so narcissistic that they won't know or acknowledge the limits of their incompetence, which makes them capable of about anything until they are arrested. With six years to remake the military hierarchy, that I doubt.

See: the Volstead act. The 18th amendment to the Constitution was widely unpopular and violated, but it lasted 13 years.
But I think the writer is right. This won’t survive Obama’s tenure. We Americans will simply ignore it—we will fail to comply/submit—just as he ignores laws he doesn’t care to enforce.
Obamacare is typical Obama: expensive, capricious & arbitrary, and impracticable. That’s why it has his name all over it. It’s his legacy, much as the Iran hostage ‘rescue’ is Carter’s and a blue dress is Clinton’s.

When John Roberts said Obamacare was Constitutional because it was a tax,he did not rule that it was Constitutional to tax a person or fine them for being forced to purchase a product because it hadn’t happened yet.Once the first person is taxed or fined for being forced to do that then it can be challenged as being unconstitutional.
I’m not a lawyer but I think that’s the way it works

Seen it before, many times. The big difference is that the people of France at that time were far more distributed into rural areas and far less dependent upon JIT food delivery.

Preppers, gardeners, Mormons, survivalists, etc. Guerilla warfare screams for getting food by raiding the enemy, assistance from the common people, trading, black market and prepared stores. There are enough firearms here to give one to everybody over the age of six. That wasn’t the case in occupied France, hence the need for the Liberator pistol. There are enough .22s here to take on the Chinese army.

Look, this is Biblical, yet 99.999% of even the believing public doesn't get it. Hell, I had to write a book on it. By the Lord's standards, we are so far from ready it's pathetic. Even the Mormons don't come close.

“Settled Law” may exist in Washington DC but not out in flyover country. Never has and never will. I could list a bunch of examples of civil disobedience by “the people” when it comes to settled law but I think most folks can tick off a few without my help.
