A Florida orthodontist sued the Obama administration on Tuesday, insisting that the White House must abandon changes it has made on its own to the Affordable Care Act, instead obeying the letter of the law as Congress passed it.
The administration has made several tweaks to the Obamacare law, including a one-year delay of a measure that requires companies with 50 or more employees to offer them health insurance or pay financial penalties.
The law specifies an exact date when that feature is to go into effect January 1, 2014 but the White House announced in July that it would push that date back, angering some in Congress who saw the move as a unilateral power grab.
The lawsuit, filed by Dr. Larry Kawa, claims that the regulatory changes violate the Administrative Procedure Act and go beyond President Obamas constitutional powers.

The sound of the crickets chirping from the Republican side is deafening.
All day long the news media has been so called reporting:

Followed by:
"AND IT'S ALL THE REPUBLICAN'S FAULT!!!
The MSM barely mentions why the government is shut down, much less cover anything about the many O care contraversies.
The Republicans should know by now , that our so called "press" will never cover their side/point of view. They should have already devised a way to get their message out to the people, in spite of media attempts to block and distort it.

Mike Lee spoke at length on this topic during the 21 hour non-filibuster of Ted Cruz, as well as on the unconstitutional rewrite by the Supreme Court. I was surprised that we have not heard any more on this subject.
Oh really. well these 'bold' Republicans have been reduced to passing a bill delaying parts of ObamaCare and the dems seem to be holding the cards. so both sides want to delay it?
Republicans should have hug tough with defunding ObamaCare and not pinned their last stand on simply delaying it which may actually help dems in the 2014 elections. The whole thing is a joke and the pubs will cave within a week. I am not even sure what Boehner is 'fighting' for at this point - a delay in ObamaCare?
If you watched the Fox lineup tonight did you notice how far behind the curve the hosts and their so-called conservative guests and analysts are?
It's amazing that Free Republic posters and Mark Levin are communicating to us and to the public up-to-date analysis, numbers, costs, facts, illegalities, lies, perversions, violations, slights-of-hand and horrific consequences abounding in and around the Unaffordable Health Care Act that other hosts, pundits, analysts and the like seem to be a day or two behind on.
Tonight, O'Reilly was hysterically babbling like a madman and spouting theories, misinformation and idiocies like I've never heard before. He was so bent on tripping up Sen. Cruz and making the GOP look bad that he made more of an ass of himself than he generally does on this ObamaKare gridlock subject.
ObamaKare was Hannity's subject also. All I can say is the spoutings of his too-large group of panelists was largely unintelligible due to massive, non-stop overtalking, interrupting each other, lack of any cohesion and coherence in the group's comments because of too many crazies in the group and a host that didn't care to lead the group intelligently...... and also because of Hannity's obvious smug delight in allowing chaos, yelling and showboating among the participants to become the centerpiece of the show...with no concern at all on his part about the lack of any edification being provided to his viewing public plus being patently oblivious of the frustrations and discomfort he was putting his watchers through.
That utter bore, Karl Rove, led off Greta's hour. He talked weightily and ponderously on obscure facts and figures that led nowhere and that no one gives a flying flock about.....and after a few minutes of this human sedative who had nothing new to offer, I turned off the tube and tuned into FR to find out what the latest news and outrages are....and here I am, without BOR's hysteria, without Hannity's tone-deafness and without Rove's (and the equally-boring Greta's) stale discussions of dated material numbing my brain.....and I shall remain here on this board for a while tonight......and I can only say....thank you, Lord, what a relief it is!

If oloser can just grant exemptions why can’t congress just do the same?
The are other suits. Some about the conscience issue, over 60 now. One about the origination clause. Probably more. We will defeat this monster and all its pernicious tentacles into our lives.
Standing seems to be something that needs to be addressed separately, as it is not in the Constitution. Surely citizens who are affected by tyranny have standing.

If the law exempts his competitor from a tax but not him, that ought to give him standing in my book.
Yeah, the trouble with these laws is they grant so much authority to the bureaucracy to make their own regulations. But that shouldn’t rule out a lawsuit based on equal protection. Obviously if they exempted all white people from the mandate only, that would be grounds for a suit.

I don’t think Cruz knew how to handle O’Reilly - he had debate quotes lined up but figured O’Reilly wouldn’t understand it.
Listening to Hannity, I was wondering if anyone has asked the ones who support obamacare why they supported it and/or if they had recently received a rate increase or lost their insurance or job.
In other words try to ask them a question which requires them to think for themselves instead of spewing talking points. How does it affect them ?
