An Albuquerque, New Mexico dad who found a naked prowler peering into his young daughter's room will face charges after seriously beating the peeping tom.
Police say Emilio Chavez III found 29-year-old Dylan Maho naked and making noises near a little girl's window when he chose to exact vigilante justice and beat Maho so badly he was taken to the hospital.
While both men could be convicted of felonies, Chavez could potentially get a longer sentence for what he did to the intruder.
'There's a naked man outside his daughter's window,' Chavez's neighbor Bill Morang told KOAT. 'I think he was well within his rights chasing him down and beating him.'
But the district attorney disagrees. Though police initially let the irate father go free after questioning, he is now charged with aggrevated battery, a felony.

The American variant of English does seem to confuse some of them.
Depends. Was the criminal peeper from a protected class? Is the father a "white" Hispanic?
More likely being Californicated.

Don’t DA’s stand for election?
It seems that someone from the neighborhood should start a recall petition
I know I would.
Sorry BigEd, I overlooked your post. You were first with the right idea.
There are some things worth going to jail for.
As of now, you could just drop him in the Northeast Heights area of ABQ, and a bear will gnaw him to nothing. I hear the cops get an average of about 10 bear sighting calls a week up there.
Winters are tolerable in southwestern Idaho. I'm originally from Nampa (20 miles west of Boise - boy see, not boy zee). That area, however, does experience some nasty inversions in the winter that trap the cold air down low and all the clouds and pollution with it. It can be 15 degrees for a week with no sight of the sun, but a quick 30-minute drive up to Bogus Basin puts you in 30-degree weather with sunshine. You look down at the tops of the clouds and you're only at 3,200 - 3,500 feet. Kinda like looking at San Francisco when it's socked in with all the fog.
Really bad advice, sir. Many years ago while taking personal lessons from an NRA instructor he emphasized that if you have to shoot, stop shooting once the aggressor starts to fall. Any further shooting and he dies, you WILL be charged with second-degree murder.
And don't think that a good CSI can't figure out what transpired. You want to take that chance?
Move to Texas, Laz. Here all the SOB has to do is be in your yard at night.
Yup. It happened in Oregon several years ago that the Benton County DA charged a homeowner who shot a car burglar. While it is true under the supposed law protection of mere property doesn’t justify use of deadly force, that DA in that deep blue city in that deep blue county ended up fearing for his own life and was ultimately intimidated into dropping the charges. And that’s the way is usually goes up there, and that’s the way it should be. There is such a plague of societal misfits around Alb, the people should rally around this father and make that DA fear them.
In Texas. they’d have to take it before a grand jury. He’s likely be no-billed
