Female Prison Guard Forces Prisoner “To Have Sex 50 To 100 Times” (Cruel and Unusual Punishment)

Philip Thomas Burris, Jr., 25, has spent his entire adult life behind bars, but that hasn’t stopped him from having sex with a woman. Unfortunately for him, it was non-consensual sex with a 38-year-old caseworker who used her position to force him to have sex with her. Burris is now suing the State Corrections Department for damages.

Burris entered Oklahoma’s Joseph Harp Correctional Center in 2007, when he was 18, to begin serving a 13-year-sentence for attempted armed robbery, burglary, vehicle theft and weapons possession. Caseworker Kasey McDonald was unfazed by his history, nor was she bothered by the three swastika tattoos decorating his body, as well as a large lightning bolt and the words “Soldier Born” emblazoned on his chest. Instead, says Burris, she forced him to have sex with her “50 to 100 times,” beginning in January 2010.

There’s no question but that there was a sexual relationship between the two. That relationship came to light when prison officials obtained a recording of a phone call between Burris and McDonald in which she made sexually explicit comments to him.

Because any sex between a prisoner and a Corrections Department employee is automatically considered rape under Oklahoma law, McDonald was arrested for rape. The state also threw in a charge alleging that she supplied marijuana to prisoners. McDonald admitted to the police that she’d had sex with Burris, but denied the marijuana charges. Her case is pending.

This is not the first time prisoners have sued the Oklahoma Department of Corrections alleging that employees raped them. In July, a group of women filed suit alleging that prison guards systematically abused them for years, and that prisoner administrators knew and did nothing to stop it.
