NYPD cops say they won't go above and beyond the call of duty over 'stop-frisk' lawsuit risks

Nypd beat cops posted a police-union warning in every precinct yesterday instructing officers not to go above and beyond the call of duty — or risk losing their jobs because of the new stop-and-frisk laws, The Post has learned.

“All officers should take action if he or she sees a crime in progress, or if he or she sees that his or her life or the life of another person is in danger . . . [But] all officers should be careful not to initiate any law-enforcement action that could be construed as violating the new legislation and subject the officer to legal action,” read the memo by Patrolmen’s Benevolent Association president Patrick Lynch.

Several rank-and-file cops said yesterday that they plan on following Lynch’s advice rather than risk their careers.

Part of the purpose of the “Stop, Question and Frisk” policy was to get guns off the streets - I.e., enforce the NY gun laws. Now that cops are afraid of getting sued if they stop a member of a “protected” group, enforcement of the gun laws will be more spotty.

So - more people carrying, more shootings. All to the good. Let them kill each other.

Usually “above and beyond” is used as a good thing - they have perverted it to indicate that it has meant “illegal police actions” and the “good” thing is that they will try to temper themselves to avoid legal consequences...

Instead of stripping citizens of their 4th, why don’t we reinstate thier 2nd. The Constitution works every time.

Stop and Frisk is done in cities where honest and working citizens can’t buy a gun and be able to carry it for self protection.

NYC is the role model. Oakland, Ca where the ferals shoot and kill each other on a regular basis may be going to a ‘stop-frisk’ system.

John Lott has given us the answer a long time ago in his well researched book, “More Guns Less Crime”.

Allow the good citizens to buy and carry guns. Then pass laws where any feral using a gun for a crime gets a minimum of 25 years in jail. Then, pass a two strike law to remove more scum.

If I was NYPD, I’d just handle my calls and go home. If that’s what the people of the city want, than let ‘em have it.

Only thing is, it's the Courts and the thugs that want it, not most of the law-abiding residents.

An astute radio host pointed out last week that the effectiveness of the “stop & frisk” policy is completely irrelevant. It would be illegal and unconstitutional even if it was 100% effective.

100% correct, but the law abiding citizens just sit there and do nothing. The activists and their ilk use this to put themselves out there and make a big deal about it. When people start dropping like flies and the crime rate spikes, they’ll shrug their shoulders and point to the cops, not taking any responsibility.

Hmmm, sounds like someone I know, a community activist who takes no responsibility for anything.

Yeah, me too. You'd think they'd have learned by now. Fortunately, the number of jackboot supporters has been steadily falling over the years. It's a trend I note with at least some degree of hope, and the statists see with at least some alarm. You've been here long enough to have noticed this trend. Believe me, it is especially dramatic if you look at the difference between now and 12+ years ago.

The people who live on the Upper East Side and all the other very very affluent areas of NYC are not going to be affected by this policy.


The affluent will hire body guards and a private police force...we be regressing to proud and glorious Mexico asap.

Rudy did not stop and frisk people walking down the street. He arrested those who violated even the simplest laws (i.e. evading paying for the subway, vandalizing, ASSaulters, etc.) and raked in the gang members and wannabes that way. People on parole can be hounded since most are repeat offenders, he did that. He sent up thugs/gang members for long sentences.

He was ten times better than Queen Bloomers and her court of anti-constitutional globalist jesters.

You're wrong. Rudy started this abhorrent program back in 1994. All Bloomie did was make it more common.

No conservatives should be lauding Rudy Giuliani, either.

Didn’t think of that aspect, but you’re 100% right. Just think of all the retired NYPD cops, in their early to mid 40’s, that would love to make some money off those folks. On top of that, an ever increasing number of the residents of Manhattan, especially, are foreign and accustomed to having bodyguards. What a cottage industry to spring up. A bunch of Creasy Bears, running around NYC.
