Judge gives teen maximum 18 month sentence for killing of 51-year-old man in 'Knockout' case

Syracuse, NY -- Onondaga County Family Court Judge Michael Hanuszczak today sentenced a 16-year-old to 18 months of confinement for the killing of a 51-year-old man.

The sentence was the maximum the judge could have handed down to the teen, who was recently found guilty of second-degree manslaughter in the beating death of Michael Daniels. The boy was 15 at the time of the incident and has maintained his innocence since his arrest at the end of May.

The judge, who is required by law to sentence a juvenile delinquent to the "least restrictive available alternative consistent with the child's needs and best interests and the need to protect the community," said he made his decision based on a variety of factors.

Typical NY where the average sentence for murder is 7 years.

I got no problem executing human trash. If you can do the crime you are old enough to do the punishment.

The Judge did as much as he could under Law. It's the laws that need changing.

Did he now?

The law requires that the sentence be consistent with the need to protect the community

Does this sentence meet that test in your mind?

How?

Then this waste of human flesh should have been tried as an adult and put away as long as possible to safeguard the community and society.

19 months from now he will be free to begin killing again. And heaven help the poor soul that attempts to defend their life when attacked by this “youth”. If they are successful, they will get the full George Zimmerman treatment from both the law and members of this forum.

If it was my family I’d wait the time and then take out him and everyone of his family I could too. The justice system has long been a failure. If the victim had been a celebrity it might have come out differently.

But for George, many innocent people would have been murdered by the subhuman Martin, who was trying to make his first bones. He’d have stopped murdering only when somebody else killed him. Thank God GZ had the courage and wisdom to pack heat that night.

Legislators are usually lawyers. Lawyers do not make any money from victims of crimes. However, they make a hell of a lot from criminals. if the public was allowed to legally defend themselves from these animals, there would be little need for lawyers, police, or courts. Protecting the criminal is where the money is. The victim? Who gives a shit about him/her? Maybe his/her family. His or her insurance company? that is about it.

You're right about the law, especially in NY, but dead wrong about the members of this forum. With a few disgraceful exceptions, we FReepers have always been some of Zimmerman's strongest defenders.

The majority were supportive, in fact, I would say that 99% were supportive. However the 1% in my opinion was too many. So I will rephrase it to “too many in future references. Thanks for bring me back to ground when I get carried away. I have strong feelings about the manner an innocent man was railroaded.
