New Jersey now disarms political 'undesirables'
St. Louis Gun Rights Examiner ^ | 13 August, 2013 | Kurt Hofmann

Posted on 08/13/2013 12:55:21 PM PDT by marktwain

Yesterday, we discussed New Jersey Governor Chris Christie's curious reluctance (so far) to ban .50 caliber rifles, despite having, just a few months ago, been the one to propose such a law in the first place. One of the ten new gun laws he did choose to sign last Thursday, though, is arguably a far more egregious assault on liberty than even the gun ban would be.

A 3687/S 2485, which, according to the title, "[d]isqualifies person named on federal Terrorist Watchlist from obtaining firearms identification card or permit to purchase handgun," finally achieves at the state level what the most rabid of gun prohibitionists have been pushing for years at the federal level. Under this law, one's Constitutionally guaranteed, fundamental human right of the individual can be trampled without a conviction, without an indictment, without even an arrest or formal charges. Actually, one's listing on the "terror watch list" is not even contingent on the government claiming one has broken any laws--simply the assertion that one is suspected of "terrorist" aspirations is enough.

Here is some of the relevant text, in which categories of people to whom issuance of a handgun or a firearms purchaser identification card shall be denied:

(9) To any person named on ¹[the consolidated Terrorist Watchlist maintained by Terrorist Screening Center administed by the Federal Bureau of Investigation ] ²[a No-Fly List administered by the United States Transportation Security Administration pursuant to 49 U.S.C. s. 44903(j)(2)(C)¹] the consolidated Terrorist Watchlist maintained by Terrorist Screening Center administered by the Federal Bureau of Investigation².

I suppose, given the current disdain for the Constitution, they could claim that this does not violate your rights, because it only applies to "licensed dealers".

Need someone with buckets of money to challenge it in court - it won’t stand.

I can’t even figure out why the “No-Fly” list can stand in court.

“I can’t even figure out why the “No-Fly” list can stand in court.”

I think the argument goes: You do not have a right to fly on commercial aviation. You can buy your own plane, or walk!

For the sake of us still trapped in this state, for your OWN sakes as legislation that succeeds in one state is often used as a template in others, PLEASE contact the Governor of New Jersey’s Office and ask him not to sign those other three bills.

He has Presidential Aspirations (God help us!!) so he MAY be amenable to comments from OUTSIDE the State critical of anti-Second Amendment legislation.

I can’t WAIT until I escape from this state.

REMEMBER this STARTED with Bush.

The BEST of intentions can and WILL go awry in government when there is a lack of INTELLIGENT forethought.

Bush et al put a sharpened sword into the hands of an enemy of America.

The first name on the list should be Barack Hussein Obama, Jr.

Y’know, if the airlines had a “no-fly” list, well, their aeroplanes, their rules.
But I’m not so sure about the Feds. Personally, I think it is something they use for harassment of political opponents.

Both Congress and the feral government courts have degenerated into door mats for the Executive branch. We are no longer a nation of law.
