“I guess they’ll have to deal with it on a state-by-state basis.”
I guess you missed Obama’s speech saying that he was going to make a point of granting visas to all gay couples requesting one.
But hey - “it doesn’t matter”. Yes, yes, it does. Now, we’ll see plenty of folks get married in one state and deliberately move to another one and sue to get recognition.
We’ll see O push for a ‘gay marriage law’, forcing all the states to recognize gay marriage. And the courts will say it’s ok. ;)
DOMA was precisely that - an attempt to protect marriage. Now that it’s gone, we’ll see the Imperial state try to ram it down our throats.
If I’m wrong on any of this, you can cite my post and point and laugh. But I don’t think I’m wrong on any of this.
1) A gay marriage law is not going to pass the House.
2) Your real issue is going to be when Tadd and Todd move from New York to Georgia and claim the right to be "married" due to the Full Faith and Credit clause of the Constitution in the absence of DOMA. If gay marriage is forced down our throats, it will be by judicial fiat.
3) It will be interesting to see what the court does when Obama tries his stunt. I'd submit you could get away with it with a NY applicant, but not one in TN.
