‘Under This Logic, They Can Do Anything!’
In the last 24 hours, it has been revealed that the National Security Agency (NSA) has been indiscriminately monitoring all Verizon phone records for the past seven years.
The stunning revelation sent Fox News host Shep Smith and Judge Andrew Napolitano into a frenzy on Thursday. In fact, Napolitano said it represented the “most extraordinarily broad search warrant ever issued in the history of the federal courts of the United States.”
Lawmakers like Sens. Harry Reid (D-Nev.) and Lindsey Graham (R-S.C.) on Thursday tried to downplay the bombshell report, arguing that such surveillance has been going on for a long time and as long as you aren’t talking to terrorists, you have nothing to worry about.
“Harry Reid says we should just calm down Judge,” Smith began.
He went on to mock Reid’s position: “This has been going on a long time, they’ve been able stop some sort of terrorism, this, that or the other thing. So just don’t worry about it, just relax everybody.”
Napolitano said the “screwy” law allows the executive branch to tell select members of Congress about secret domestic surveillance programs, but prohibits them from telling other members of Congress or the American people.
“Just because Harry Reid knew about this for seven years and it’s been going on for seven years does not mean it’s constitutionally permissible,” Napolitano said. “This is a fishing expedition on the grandest scale we’ve ever seen in American history.”
He went on to say the Constitution requires the government to present evidence to a judge relating particular individuals if it wants to seize personal information like phone records of American citizens.
“Rather than doing that, they got a search warrant for 113 million phones,” Napolitano added.
“That we know of!” Smith interjected.
Judge Napolitano then speculated that Director of National Intelligence James Clapper “lied under oath” when he testified that the NSA wasn’t collecting any type of data at all on hundreds of millions of Americans.
“Not wittingly,” Clapper said in March. “There are cases where they could inadvertently perhaps collect, but not wittingly.”
Smith went on to say that only the court order relating to Verizon’s records have leaked, meaning that the NSA is likely monitoring other phone companies as well.
“Who are we to think they didn’t do this with all of them?” he asked.
The idea that Americans would sacrifice liberty for safety is a “canard,” Napolitano chimed in. He said “this is the most extraordinarily broad search warrant ever issued in the history of the federal courts of the United States.”
“Under this logic, the government could send people to all of our homes, put them in a bed next to us, have them watch everything. Under this logic, they can do anything!” Smith added.
If the owner voluntarily permitted a government agent to search their home, they essentially waived their 4th Amendment right.
If the police come knocking on your door, you are under NO obligation to open the door for them. You can communicate with them through the door or you can go back to your business. Without a warrant signed by a judge, no law enforcement officer, local, state or federal, has the right to enter your home.
Since the Feds have admitted to recording and cataloging your every word and every movement by your phone, through email, text messages, and social media, they have admitted to being part of a conspiracy to deny the right to privacy to every American. That’s a violation of the 1st, the 3rd, the 4th, the 5th, the 6th (right to face accuser), the 9th, and the 10th.
This government is completely out of control, folks. They are literally destroying everything America stands for. Oh, but wait... I think Dancing With the Stars and Duck Dynasty are on the TV. Don’t want to miss those. Maybe we can have the revolution some other time. I’m busy.
They've already proven they cannot be trusted w/personal info. The IRS released a list of conservative donors to a liberal organization in an effort to give them political advantage.

Reid is right. Clinton and Obama administrations have thwarted the Christian, conservative, and veteran terrorism that threaten us.
Obama's DHS targets Christians and veterans; now comes Obama's Holder Department of Just Us and Our People, Obama's IRS, et al. They are targeting us Tea Party folks and Americans in general critical of him, the Great Leader Obama mmmm mmmm mmm, and thus a threat to America.
..in the Clinton years there was an obsession over Christians while Islamist terrorists roamed barely noticed; e.g. Project Megiddo was a Clinton Administration FBI, SPLC and ADL massive investigation that warned LEO nationwide to prepare for Christians going violent as the year 2000 approached. And those anti-abortion folks they're another existential threat warned Washington.
Our traditional political heritage is now criminal, sedition, and even treason. What the hell is going on in our Country?

We had a situation where top management wanted us to set up all our computers so that any information our auditors had would be downloaded and backed up on the main system EVERY DAY.
I already knew there were 17 separate federal laws that PROHIBITED that action to the degree any of the information subect to 'backup' belonged to a third party.
So, I objected.
Eventually I won although the batarde behind the daily backup stuff also tried to restrict us to no more than one computer per specialist/auditor.
What a tard ~ he was taken out blind folded shortly after I retired.
So far those 17 federal laws are still on the books and the penalty is applicable to any manager who directs a violation, or any subordinate who takes an action in violation of those laws, or any one of those laws.
The penalties all include fines and imprisonment.
That's not even involving federal security violations. NSA employees and contractors are subject to those 17 laws plus all the security laws.
Only a very special sort of person knowingly violates any of them ~ normal people don't!

You are a bit confused. Judge Napolitano is a die hard Ron Paul Libertarian, but he used to sub for Glenn Beck and became his fan. The Judge is still on Fox News, but he was given a Fox Business Show. FBN has been having issues trying to hammer out a lineup. They wanted to move Cavuto and change up the lineup last year and ended the judge’s show. It came after he did a monologue claiming both republicans and democrats are the same in Washington D.C. So the rumor was the judge was too hot for the channel.

napolitano did end up on the wrong side on that issue ~ he ignored the fact the Constitution itself does have a provision allowing for federal involvement in national elections (those for Congress, the Senate, or the Presidency) ~

As I pointed out earlier and you skipped over it, the government REQUIRES that those phone call records be created ~ and there are a wide variety of reasons why that's done. However, modern technology is sufficiently robust we could probably run a serious communication system without keeping those records.
Anyone else please do the same.

That law was created to stop the monopolization of the bells by AT&T. We have anti-trust laws now that do exactly that. There’s no reason to track this information.
And if you believe that they ONLY have transactional information on phone calls, you’re delusional.
Explains why Holder couldn’t say that he wasn’t spying on Congress.
The transactional information generated by your average connect is huge ~ and unwieldy!
The Judge always loses me with his support on Ron Paul. His son is still trying to feel his way around D.C. But is slightly better than his pops.

Actually, the amount of data required to pinpoint a person’s location, duration of call, and who spoke when and for how long fits neatly into a file between 100kb - 768kb.
The new NSA data center in Nevada has over 1 YOTTABYTE (10^24 bytes) or 1 TRILLION TERABYTES of storage. This is documented and has been in the news as of late. That’s enough space to store 10^18 (1,000,000,000,000,000,000) 1mb files. That’s enough to store over 2 TRILLION phone calls PER US CITIZEN per the previous parameters.
Again, if you think that they aren’t recording and saving everything about you and your life, you’re delusional.
