A gay couple is pursuing a discrimination complaint against a Colorado bakery, saying the business refused them a wedding cake to honor their Massachusetts ceremony, and alleging that the owners have a history of turning away same-sex couples.
As more states move to legalize same-sex marriage and civil unions, the case highlights a growing tension between gay rights advocates and supporters of religious freedom.
"Religious freedom is a fundamental right in America and it's something that we champion at the ACLU," said Mark Silverstein, the legal director of the group in Colorado, which filed the complaint on behalf of the couple. "We are all entitled to our religious beliefs and we fight for that. But someone's personal religious beliefs don't justify breaking the law by discriminating against others in the public sphere."
The attorney for Jack Phillips, one of the owners of Masterpiece Cakeshop, sees it differently.
"We don't believe that this is a case about commerce. At its heart, this is a case about conscience," said Nicolle Martin. She said the matter is important because it will serve as an example for future cases across the country as more gay couples gain legal recognitions for their relationships.

Just tell them, “We’re all booked up”.
They didn’t want a wedding cake. If they did, they wouldn’t have gone to a bakery that has “history of turning away same-sex couples”.
They just wanted to start something.
Whatever happened to “We have the right to refuse service to anyone”?
Neither Oregon nor Colorado recognize fake marriage, so I don’t see that the homos have a case. These bakers are AFFIRMING state law, the will of the people.

This is going to be awful but I am so sick, SICK, of the homosexuals cramming their chit down our throats. People should decline to make the cake if it is against their beliefs and if the homosexuals insist YOU MUST be slave to their beliefs and not your own...well, it would be so sad if something nasty landed in their cake.
I would give them the cake but would make sure it didnt taste or look good.
Better yet, send them a really, crappy cake. It is hard to bake well, when your heart isn’t in it.

I do not attend “ Gay Weddings”. Never have, never will!
If One did attend could One be assured what was in the cake icing?
Not much difference at all. If they truly wanted a baker to make them a nice cake - they would have gone to a baker who specializes in those things. Ya know they’re out there.
And - why, for goodness sakes, would they go all the way to Colorado for this cake, when they LIVE in Massachusetts? It has nothing to do with this cake.

You have demonstrated that evidently gay genes come in pairs...one for gay behavior and the twin for stupidity and obnoxious behavior.
We have a fix for that stupid part...GO TO ANOTHER BAKERY, idiots.
If I owned a bakery, I could get around this. I’d be nice to the couple, very willing to please, excited that they can finally share their love openly...I’d deliver a beautiful cake, lovely as a spring day on the outside....and nasty as all get out on the inside.
Of course, I’d be appalled and saddened at the total failure to add vanilla or the proper amount of sugar or egg..or the use of cornmeal instead of flour. The cannister, somehow, was labeled wrong.
I’d refund their money and be so sad over the mistae, itd be quite pitiful.
Really. If gays are gonna sue bakeries, at least let it be over a legitimate mistake...

Whatever happened to the right of freedom of association?
Libertarians are naively telling social Conservatives to give up on fighting gay marriage. Gay rights advocates want more than marriage they want group think.
The states have never amended the Constitution to protect so-called gay rights. So constitutonally express religious protections trump state gay protections.
Also gay protections advocates cannot hide behind 14th Amendment equal protections clause to justify such protections. This is because, since Section 2 of 14A discriminates on basis of sex, the equal protections clause was clearly not intended to apply to sex.
The reason we are wasting time with such controvercies is because parents are not making sure that their children are being taught the Constitution as constitutional lawmakers had intended for it to be understood.
