A federal judge on Wednesday ordered the U.S. Health and Human Services Secretary to suspend existing organ allocation rules to give a 10-year-old Pennsylvania girl a better chance at a life-saving lung transplant.
U.S. District Court Judge Michael Baylson told Kathleen Sebelius to direct the Organ Procurement and Transplantation Network, or OPTN, to make an exception to the so-called "Under-12" rule as it applies to Sarah Murnaghan, who has end-stage cystic fibrosis, for at least 10 days, until a hearing on June 14. That move means that the girl can be considered more quickly for organs as an adult, instead of being limited to the pediatric transplant list.
The ruling, which grants a temporary restraining order, applies only to Sarah, although Baylson indicated that he would consider a similar move for another child in Sarah's circumstances, if a family presented the case in court.
“Who’s saying some other recipient will get denied?”
Well the demand exceeds supply so there is a waiting list. Many die waiting to get a lung. I guess you could say some were not denied per se but just couldn’t survive long enough to wait for one. My understanding is this judge’s actions only allow her to ‘compete’ and request a lung via the lung allocation system. She would then need to get on the waiting list and not sure if she can make it for several months ...

Well now, I’m sure the good federal judge is gonna fix all that with his next court order.

>> Sounds to me you are “blessed” as such, too
Check your hearing. I haven’t divined any particular outcome.
Thank you for reasonable thinking!
Do you not get they had to sue the government because of THEIR regulations??
Hey, trust them if you want, I don't.
Want to see a fire storm, let's deny homo's treatment because of their behavior, they will do it to smokers and obese peoples too....don't eat the food the "panels" recommend, don't wear your seat belt, don't ride your bike the proscribe 30 minutes a day?
Er sorry, we're not giving you care.
This is a very slippery slope, the government has no business in it.....unless of course "they're" paying for it, then they control you and every aspect of your life.
Welcome to tyranny...."Medicine is the keystone in the arch of socialism~Vladimir Lenin
Why?
If I wasn't to sell and organ, it's my choice right?
I mean it is my body.
If I want to sell a kidney and I'm a medically worthy donor, why can't I sell it on a free market.
Oh, I'm a man, choice to do with my body only counts if I was female and want to murder my unborn child, got it.
This is the problem when government gets involved, they can only have authority when they pay for it! (Actually, we pay for it, but they control how it is spent)
A transplant is no the be all end all to this child’s illness. A tx would only trade one diease for another, She will NEVER have a normal childhood
Be careful what remedies you take for a problematic situation. In the future one of Obama’s judges, there seems to be many, who will make his own decision that discharges proper actions against Obama. As to this case with the child I would have preferred that the judge ruled upon the Constitutionality of a law, his province, that was prejudiced against a person because of age. Perhaps this was behind the judge’s ruling. However, the news reports came out like the judge said ‘I am a judge and can make anyone dance to my music’. Judges with such an attitude are no friends to our Constitution.
I have the same feeling.
exactly! She would probably require another tx at some point.
No I haven't... That's amazing to hear!
It’s not about you selling your organs, it’s about preventing unscrupulous people selling the organs of others.
Unpleasant people already sell women and children, you think they won’t stoop to selling stolen organs and chopping up people like they do cars?
The money is too big and wealthy sick people are too desperate. That’s why they don’t open that can of worms.
Rich people already travel to Asian countries for organs of uncertain provenance. You want that in this country?
Tough situation all around. As in life, there are always winners and losers (sorry, don’t mean to sound cruel but that’s the way it is)
By beef is with government involvement and authority, that’s all.
You are welcome. There is a lot of emotion on this thread, but not a lot of knowledge or logic.
I have Pulmonary Fibrosis, terminal without a transplant.. NEVER SMOKED A DAY IN MY LIFE.
Oh man, for every advance in technology or in civilization in general, there will be those who pervert it for immoral reasons and ends.....such is the nature of man kind.
This is a very difficult dilemma, one that I don’t trust the government to be involved in, especially this one, that’s all I’m saying.
