The 16th must be repealed by an amendment that prohibits the income tax at all levels: local, state, federal, and international!

We need to coin a new name for the Income Tax since it is actually a Slavery Tax or Sharecropper Tax.

We should call it the Suicide Tax because it kills any nation that implements it.

Not exactly. The SCOTUS in Minor v. Happersett defined "Natural Born Citizen," concurring with Vattel's definition. (Minor was not a presidential eligibility case, however.) Vattel is considered to be the Framers' source for the term.

This is so typical of leftist constitutional thinking, using sleight of hand, as Dersh does, to change the original meaning of "Natural Born Citizen" in order to effect a result that pleases his ideological tastes. No, Dersh, your error is to split all citizens into only two classifications. "Citizen at birth" and "Natural Born Citizen" have never been synonymous terms. The latter is a subset of the former.

Same holds for Eugene Volokh, who might be interested in changing the Constitution to help out his friend Ted Cruz. But as Theodore Roosevelt famously said, "No man is above the law." That should hold a fortiori when we're talking about the supreme law of the land!

That federal law is naturalization laws, codified as 8 USC.

Article II specifies “natural born citizen”, or “citizen” at the time of adoption of the Constitution.

A naturalized citizen is not a natural born citizen.

BTW, a few months ago, I saw Ted Cruz asked on TV if he thought if he was constitutionally eligible for the presidency. He didn't give a definite answer.

Of course, no one disagrees with the statement that Cruz is an American citizen. And he may have been an American citizen at birth, depending on what the statute was at the time of his birth.

But, as I said, "Natural Born Citizen(s)" is(are) a subset of "citizen(s) at birth."

I was reading that our Framers never really defined “natural-born citizen.”

They never formally defined "Natural Born Citizen" because the definition was well understood among the erudite of their time and place. The term had been defined by the Swiss political commentator Vattel about thirty years prior to the creation of the Constitution, and the Framers had read Vattel (most could read French) or knew from their contemporaries what Vattel meant by "Natural Born Citizen": a person born in a particular nation both of whose parents were citizens of that nation at the time of that person's birth.

During the Constitutional Convention, John Jay (who was not present and who was so distinguished a lawyer that he would become the first Chief Justice of the Supreme Court) sent a letter to George Washington (who presided over the Convention), recommending the requirement that the President be a "Natural Born Citizen." Washington didn't have to ask Jay or anyone else what Jay meant in his letter. He and the others present all knew very well what "Natural Born Citizen" meant.

Any attempt to suggest otherwise is revisionist history, calculated to change the meaning of the Constitution so as to falsely create presidential (or vice-presidential) constitutional eligibility for current people whom one might favor but who do not meet the Natural Born Citizen requirement.

Obama would not be a natural born citizen if he was born in Kenya because his American mother was not 21 yet the law at time would not have given him citizenship at birth if were born outside the country.

Cruz’s American mother was over 21 so he would been a citizen at birth even if he were born on Mars. That’s what natural born citizen means, citizen at birth as opposed to a naturalized citizen. Jindal and Rubio are also eligible cause they were born here to legal resident parents and were citizens at birth, period.

Some may disagree but it’s clear how the courts would rule if some idiot filed a lawsuit.

I swear it seems to me that the people who couldn’t swallow the unlikely idea of Obama’s pregnant mommy hopping a transatlantic flight so she could give birth in a village in third world hellhole just made this other stuff up on the spot. I wish to hell they’d stop using it poo poo the idea of Cruz, that only helps Obama’s side and makes us look silly rather than “principled” which is what they are going for. Honesty, to keep talking about this is ridiculous.

A few of these “birthers” are my FRiends but I have to strongly disagree here.

Nothing stands in Cruz’s way except the voters and I’d like him to be the next President or VP to Scott Walker, the only other potential candidate that fires my imagination.
